Hi there all, quite new on here and 1st post in SPL.

This bit in one of the news articles confused me:

"The car had been recorded speeding on sixteen different occasions around Northamptonshire and the Buckinghamshire area. However, a reading of how fast it was travelling could not be obtained because the jammer device interfered with the detectors."

So.... How do they know it was speeding?

Seems rather excessive to lift someones car from their driveway at dawn and take it to bits.

Case law says that a police constable is qualified to judge a vehicles speed so on that basis they knew it was speeding. I haven't yet read the link but it looks like the driver was taking the **ss. I mean, come on 16 times! I'm assuming the number of times is true.

I wonder if the police can remove your car from your own driveway and inspect it without your permission?

I think if they suspect you of perverting the course of justice and can evidence that suspicion as they could in this case they could then apply to the Magistrates Court for a search warrant.

Question does arise - did he just leave his jammer on all the time or did he follow the proper procedure where he turned it off as quickly as possible once detected?

If he didnt turn it off then he deserves all he gets as he is ruining it for the rest of us.

I don't know the ins and outs of the legality of laser jammers, but that page is pretty poorly written and smacks of scare tactics. Two of the 'news' articles are practically word for word identical, just place names have been changed and the email from the DoT doesn't even mention perverting the cause of justice.

As far as I know only a couple of people have been charged with perverting the cause of justice for having a laser jammer and they were all extracting the urine somewhat. They also admitted the offence, people seem to think the charge wouldn't stand up to scrutiny. All likely to become moot soon as the government will be explicitly banning them anyway

The bloke has admitted it. Mistake N01. Jammers are not currently illegal, as admitted by everyone in law.

You can only pervert the course of justice if a crime has knowingly been committed. As there is NO proof of a crime, a good lawyer would have got him off if it ever actually got to court. I doubt it would get that far as they know it would set case precedent and rule out further prosecutions.

Yes, that's set to change, but currently it would be possible to blow the CPS away.

If you want to remain safe, the best advice currently is to damage a plate. It carries the risk of a £30 fine, but it's better than Gordons £60 tax & 3 points

I'm not sure about this case and the details but wouldn't the photos be evidence? You have multiple pairs of photos from different cameras showing the same vehicle giving an error. Photos of other vehicles both immediately before & after have readings. Each event has two photos of the vehicle where the speed can be calculated by the markings on the road and the time from the camera.

These are cases from scammers, not fixed gatso's. IIRC, you have to have proof of a crime before you can pervert the course of justice.

Either way, make sure your plates are not fully readable ( you only need one letter missing, they are not allowed to trowel the PNC) or let's all go on a camera cull

I think the solution to this latest problem, is to simply remove your jammer for a few weeks following the second 'ping' from a Talivan. Then, if they do seize your car and investigate, they won't find a thing. As a double bonus you could charge them for waisting your time

I think the lesson of this one is: take the piss by driving multiple times through laser traps in one area and jamming them and they are likely to throw the book at you; use a jammer sensibly, i.e. to protect against a laser trap that you haven't spotted and switch it off immediately and it is unlikely that you will get into trouble.

Surely attempting to pervert the course of justice is tampering with evidence/falsifying etc. In this case there is none.

Yes, that's the way I see it. There's no justice to pervert because there's no evidence / no proof.

Which is unfortunately why drivers with broken/missing/dirty number plates rarely get the benefit of the doubt nowadays...

Most jammers don't give any error codes at all, and when using a laser gun it's not always 100% possible to get an instant reading if any reading at all. So it would'nt be unusual to not a get a reading on a car maybe 1-20 as a guess.

Also if the sun is low in the sky the gun won't work too well pointing in that direction & direct sunlight on the lens gives the same nil reading on the lasergun.

There are a few cars that are difficult to target, 200sx's, MR2's, Jag XJ's, Seven's, anything with a small low profile front etc. Now if you had a jammer on your silver shiny MPV thing then they might be suspicious as they are dead easy to ping instantly.

Keep your eyes peeled for a little article on a certain beeb news program in the coming weeks.
