A member of my staff knocked a pedestrian over when exiting a petrol station today.

Emergency services called, pedestrian taken to hospital, driver cautioned by police and told they will be in contact after reviewing CCTV from petrol station and completing the taking of witness statements.

Driver was cautioned and advised when asked what they could expect was told by police that a 1 day course would be likely.

Driver has to tell me this as it could go on record with who we work for depending on outcome.

I'm assuming driver will be charged with Driving without due care and attention, but is the course available for this as i thought it was speeding only for the course?

Out of curiosity if the pedestrian is found to be in the wrong can he be charged and forced onto an awareness course or is it more victimization towards the driver.

How can a pedestrian be "in the wrong"?

Well, if you are wondering into the road in front of a moving car when you don't have right of way? And IME this little trick is often undertaken when the vehicle in question is within 30-50ft thereby requiring it to brake hard.

Stop and motion for a car to come past. Then leap in front of it and claim compo. Dafter plans have been used.

Actually, a real life case I was involved in - chap gets cut up by bus. Chases bus up hill and drives in front of, then gets out his car. Bus traverses around the now parked vehicle and peeved pedestrian who then dives into the front of the bus, and then calls the police for "being run over" and sues the bus company....

Many years ago I knocked a pedestrian over. 3 lanes of traffic and i was sat at the front in the far right lane as all 3 lanes were stopped on a red light. As the lights went green all 3 lanes of traffic pulled away and then out of the corner of my eye I saw a pedestrian run out from in front of the van to my left. It was a teenage girl who had tried to run across the road just as the lights had changed to green (there was not even a pedestrian crossing at this junction).
I swerved right into the side of the road and braked hard, she hit the left side of my car, damaging the wing and passenger door. She was injured and led in the road next to my car as I called an ambulance.
After a police(and insurance) investigation I was told that I was not at fault, nobody said the pedestrian was in the wrong but in this case I think that it would be a valid opinion.

Kids run out in front of moving cars all the time, especially now that Alvin Stardust isn't around to tell them not to.

LOL - really?

In 21% of fatal accidents involving pedestrians - it's the pedestrians actions that are deemed to be a significant contributory factor.

Yeah, suspect it is an attitude all too common these days, and is one of the reasons why f**kwits just step into the road without looking, or worse, see you coming along the road then step out anyways..

My uncle killed a pedestrian in the 80s who ran out between high sided stationery traffic into the path of his car.

No action against him by police etc, but it wasn't a very pleasant experience for him (or the pedestrian's family). His insurers picked up the cost, less his excess.

Still, these things are pretty rare, and unfortunately - like cyclists, when they screw up+ i,t tends to hurt them a lot more than if they were in a car.

Pedestrians tend to be complete numpties, but as long as you expect them to be totally unaware of traffic, you can't go far wrong.

I suspect so too. I defy anyone to watch these vids - then tell me pedestrians cannot be "in the wrong".

I hit a kid about 5 years old in my Range Rover. He was on his own with ear phones in and ran our between two parked cars.
Ambulance and Police arrived I was breathalysed the Kid was taken to Hospital and later sent home with no injuries.
Fortunately for me I was doing about 15mph if I had been doing 30mph the outcome would have been different for us both.
The Police took no action against me mainly because I did nothing wrong but its not a very nice sight to see anyone on the floor after your car has hit them it leaves a long lasting scar.

fk me, are you really saying you never walk anywhere? Pretty much all drivers are pedestrians too...

Would it be advisable to inform insurers - they might be unhappy to later find they have a large PI claim hanging over them?

No one has asked how the driver of the vehicle is?

I would suggest that they get back in a vehicle and drive even if they don't feel like it. They are probably feeling pretty bad at the moment. They are probably considering not driving so you could lose a driver.
