Hi PH'ers,

Apologies in advance; I've tried Googling round this but the results are saturated with "no win no fee" solicitor adverts.

A friend of mine was involved in a minor RTA in June 2013, whereby she went into the back of someone who was stationary. Very low speed (would guess < 10 mph, no airbags, minor damage i.e. her front numberplate was wonky by half a CM). She had fully comprehensive insurance and everything was reported to the insurance company the same day.

Fast forward to today, she has received a form Practise Direction 8B - Pre-Action Protocol for Low Value Personal Injury Claims in Road Traffic Accidents. This form states the defendant needs to reply within 14 working days and my friend is quite worried and flustered about the whole thing! I've advised that her insurance will deal with this and not to worry. Unfortunately the insurance company is shut and all the websites return advice on how to make a claim, not how to deal with one against you.

Anyone been in a similar situation? Is my advice sound? Should I start freezing sausages to hammer into lawns now?? Any advice is much appreciated.

Thanks,

Robert

Ring the insurers on Monday and let them deal with it. Whiplash unfortunately is so difficult to prove or not that the claims likely to be settled rather than contested.

Send it to her insurers.

That's what they get paid for.

Thanks chaps, will do.

Seems a bit strange that (kind of formally threatening) form was sent directly to my friend and not just to the insurer.

Seems to be standard practice by the ambulance chasing brigade.
Forward it to her insurers when they're open again & do the same with any further communications.
(Usually a good idea to keep a stock of frozen sausages, never know when they might come in handysmile)
