Child care shared 50:50, divorced couple, who gets the child benefit?

Either can.

Or are you asking who will if there is a dispute?

Should have been clearer, yes in case of dispute.

It's paid to the mother, historically to stop the father spending it on beer.

You can switch it over, but it's difficult. I tried as it would have meant I wouldn't have to sign on every week to get my NI stamp, as I could be classified as the children's main carer.

But if it's in dispute, no chance.

So if in dispute should go to mother?

HMRC will pay it to the parent with whom the children live.

So unless Shared Residence Order is obtained, I would say the default is likely to be deemed the mother.

So no shared residence order, but 50:50, goes to mother?

It would normally go to whatever parent spends more time with the child.

If it's truly 50:50 which is not very often in real life scenarios then i would wager it would go to the parent who earns the least amount of money.

It always goes to the parent the child lives with full time, even if its the father.
Many many years ago my then wife left,I got the full child benefit and the extra single parent allowance.
She had full access and was even liable to pay ME maintenance.I did not ask for it as I had my son,the house and everything worked out in my favor. "I`m a single parent with my own home" was the best chat up line ever with the ladies.

This I understand. However in a true 50:50?? Criteria to determine??

True 50:50 is impossible as there is not an even number of days in a year.

This is HMRC's criteria:

HMRCs criteria don't really answer my specific question. So in a situation where the child is 3 days one parent 3 days other, dows this make eligability for child benefit alternate year to year.

Maybe actually nobody knows and I'm being too pedantic. But it's a real situation I'm trying to help someone with!

Who earns the least amount of money?
Why don't they make an agreement where they split the money regardless of who receives it?

Ever seen an acrimonious divorce? In which every last nut bolt & widget must be fought over.

It'll end up with the mother regardless of what should happen.

CB should be taken into account in determining the overall financial settlement as part of the divorce proceedings. If the parents can't agree about CB they have sod all chance of agreeing about anything else so it may be easier to pay it straight to their lawyers.
