Just got nabbed driving my wife's car over Christmas doing 94mph on the A303 Mere Bypass.
Although guidelines state that I should get a FPN for this my wife has been issued NIP stating that it will be dealt with in the courts.
Can anyone tell me the following:
Why although 2mph under the guidelines am I probably going to end up in court?
How I minimise the damage?
Also if I am right I believe that your wife cannot be forced to give evidence against her husband in a court of law can we use this as a loophole to avoid her naming the driver at the time of the offence?
Any help to beat the money grabbing, crime ignoring, and waste of space we call a police force greatly appreciated.

While I sympathise - I think calling the "police force" that is a little unfair. It's a crap system, run by a crap government - however - there are many in the force, I'm sure, doing an honest job as best as they are allowed in often difficult and dangerous circumstances.

I was under the impression that the 'guidelines' for issuance of a FPN end at 86mph in a 60 zone? This is what the trafpol who stopped me showed me (printed in the back of his folder, on the back of the producers book IIRC)). I was doing 96 in a 60 NSL and am waiting for the summons...... been 4 months now. Roll on 6 months and the statute of limitations (again, IIRC!)

It is weird, isn't it, that a married couple could kill their child in the marital home, and if both of them keep quiet and there's no other evidence, they both get off scot free. I remember a case reported in the media a few years ago where this had "allegedly" happened.
But if one of them happened to get caught by a speed camera, one of them would end up with points and a fine, whatever happened.
Priorities, eh ?

The job you mean was were two scum - sorry, no other word - both blamed one another for killing their foster child. While they walked the murder, as the prosecution couldn't prove who inflicted the fatal injury, they did both get potted for manslaughter and neglect. Hopefully they;ve just spent another Christmas Day with Mr Big who's in with all the warders...
Re the loophole about not being forced to incriminate yourself, this is all well and good when people are getting themselves off minor driving offences. Not so good when the three car thieves who've made off with your pride and joy use the same loophole to refuse to say who the driver was... and all walk.

Back before the days of scameras, I recall winding my Stage 2 Manta GTE up to around 125 mph indicated on the totally deserted A303 Wincanton bypass one fine Christmas afternoon......
4000 rpm gave 90 mph in top - an all-day autobahn speed which the tail spoiler and uprated Bilsteins handled very nicely...
Not that I'd do that sort of thing in the UK these days, of course Ossifer. Ooh no, dearie me no!

As so many people seem to take my last comment as offensive, I thought I should explain my rational behind it:
My local police station was outsourced to a town over 25 miles away last year even though the Police station in the local town 5 miles away served our community better and to accommodate this my POLICE council tax charge went up by 28.8%. Last summer my 98-year-old neighbour had intruders on her property and rang the police terrified. She was told that there was no way a car would be able to respond in time and she was advised to go next door and get help from her neighbours. Now I don't mind doing the police's work for them as long as they pay me but I take umbrage when I am expected to pay an extra 28.8% for the reduced service they offer and be forced to become a part-time community police officer. I have often informed the police of anti-social behaviour and minor crimes only to be told that it is not serious enough to respond to, including vandalism to my own car. Yet they always seem to find time to address the crimes of speeding motorists, 95% of whom are driving within their means on empty, straight roads causing neither damage or danger to anyone. Had I been doing that speed in a built-up area near a school I would expect to receive an automatic ban and rightly so. A bit of balance is what is needed and it would be given if this was aimed at creating safer roads and addressing crime. The explosion of speed cameras and use of parking attendants in towns offering limited and expensive parking is simply a means to increase revenue by councils and the local police forces.
Hence I stand by my comment in the previous post.
I have requested under the new Freedom of Information Act the statistics for fatalities and serious injuries for that particular stretch of very straight and very wide dual carriageway. I am sure the figures will disprove the need for a camera on this stretch of road to reduce traffic accidents and can only indicate that it was positioned to raise revenue.
I have had a foreign friend who lives abroad offer to be the named driver. He is on a different continent, if he did this would the CPS pursue him for the offence or give up?
Im trying to work out where the camera you mention is placed - there aren't many on the A303 - theres a couple on the brow of a hill (nr Tisbury IIRC) and there used to be one hidden behind a bridge support (down towards Devon IIRC) but other than that I can't remember there being any. There were a couple in the 40 limit roadworks nr Wylye recently, but I doubt you were doing 94mph there!

I don't suppose you'll be ringing them if you get assaulted, mugged or burgled will you
The NIP should really be given in all cases where speed is involved. However, if given a fixed penalty ticket at the roadside, there is no need for the NIP. Although I always say it....as it informs the driver of what will occur should they fail to comply with the FP scheme.
Unless it's a speed camera complying with regulations set out, the money won't go to the police, but to central government.
Anyway...that's about it for advice...

It's the other 5% that you have to be careful of. Still a lot of drivers.
People don't (usually) get KSI'd by vandalism (although it's an horrendous social curse), but it pales into insignificance compared to a loved one being killed (or killing someone else) in an 'accident'.

If it was a straightforward camera partnership penalty you'd probably get away with it. If it's going to court, then a lot more dodgy. With either process, is it worth the risk? If you get caught then you're going to jail.

No if u read my 2nd post you will realise why, I hardly think a 90+, partially deaf woman will be much use in stopping a burglar. I suppose I could always take the risk of tackling the burglar myself and either get stabbed to death or strung up for Murder.

No if u read my 2nd post you will realise why, I hardly think a 90+, partially deaf woman will be much use in stopping a burglar. I suppose I could always take the risk of tackling the burglar myself and either get stabbed to death or strung up for Murder.

Yes, indeed, but it's not the police you should be directing your wrath at, it's the policy makers who prioritise the use of resources in the way that they do. I don't believe there is a single BIB on this forum who would disagree with your thoughts on where resources should be directed, but they are simply following the directives set from above.
