A friend of mine want's one of my cars (he's broke and I'm letting him have it for next to nothing) only trouble is that it is on a sorn, it's off the road at the moment but will need to go for an MOT. All I am worried about is that because it is on private land with no insurance he has said that because his insurance covers him third party for someone else's car he want's to take it to the MOT, but I have A friend of mine want's one of my cars (he's broke and I'm letting him have it for next nothing) only trouble is that it is on a sorn and needs an MOT, it's off the road at the moment but will need to go for an MOT. Is he covered to take it for the MOT ?

Get the paperwork done before the car moves and it`s not your problem. This will however invalidate his third party insurance on the car.(Actually that`s a dumb point to make - vehicle must be MOT`d for insurance to be valid). He should contact his insurers who may offer 1 day cover just to get it through the MOT. I`m not BiB, but hope this helps.

Sorry Steve got to disagree with you.
IMHO the car owned by drifter can be driven to a MOT by and on his friends Insurance provided it contains the standard clause that Additional Cover is provided in that he as policyholder (friend) can drive a motor car not belonging to him and not supplied to him under a hire purhcase agreement or vehicle leasing agreement, Further, that there is no further restrictions mentioned in the small print of the Insurance Policy.
This is providing that a pre-arranged appointment is made then the travel to and return is exempt from Excise Duty and MOT (but not items which are unroadworthy under Con and Use).
Many think that the owner must have current Insurance for this to be allowed but it is not the case. It is fraught with some danger as if friend stops driving and leaves the vehicle on a road then the onus reverts back to the owner for it to be Insured.
There is a section in the RTA 88 [148 (2) (b)] that prevents Insurance Companies from renaging on third party risks once a certificate has been issued in relation to the condition of the vehicle so if anything untoward was to happen then a third party claim would be paid by the Insurance Company who may take civil action to reecover what they paid out against the driver because of defective vehicle.
As to long term use by the friend if MOT and Excise OK then it would be most prudent to see what the Insurance Company would allow other than emergency use which the clause caters for. I do not think they would be impressed.
Another word of warning if anyone lends a car to someone else having been told the others Insurance covers use MAKE SURE YOU SEE THEIR CERTIFICATE/ POLICY
has this effect. The offence is use, cause or permit No Insurance.

Steve.
Like anything the Regs appear to be simple. BUT
They make the exemption for a MOT for a vehicle proceeding to and return from a test and/or to a place of repair.
Now under Con and Use it is an offence to have duff tyres, steering etc. Under the Con and Use Regs that cover these defects there is no mention that it is OK to drive the vehicle while proceeding to a Test etc. so offence committed. This is therefore in conflict with it stating ...to a place of repair.?
The presumption in the mind of the legislators msut have been that we all submit vehicles in tip top condition?
