Witness in DWDCAA - case delayed
Discussion
It's a disgraceful situation that I commonly encounter. The court has targets to meet - plea to trial date. Multiple trials will be listed on the same day in the same court. It's now normal practice for a trial court to be triple listed. The court can't possibly accommodate three trials, so two defendants, their witnesses, and all prosecution witnesses will get an apology and another date. At which point, your trial may have a 'priority listing' - which is completely meaningless when you're listed with other 'priority' trials - such as domestic violence, which will take precedence. Your case is careless driving - non-imprisonable. If you're listed in the same court as anything other than a minor motoring offence then your case likely won't be heard and you'll be given another date. As a witness, if you indicate to the CPS that you're no longer prepared to attend voluntarily then they will get a witness summons compelling your attendance.
What you have described is exactly why those who have to take a pragmatic view of their finances will, if they realise how much they will be disadvantaged, be less inclined to do the right thing and come forward.
As a poster on the other thread succinctly put it - "Sorry mate, I didn't see it". Kerching.
Not good for justice.

I know what you mean and I would hate to become that person but I can't help wonder As a poster on the other thread succinctly put it - "Sorry mate, I didn't see it". Kerching.

I actually went along to my court for the afternoon anyway. By this point I was so prepared for doing it I still wanted to go and see the process even if my case wasn't being heard. They complained frequently of how busy they were.
Surprised at the number of domestic assault cases. And the number where the assaulted was present.
One question. Do the female lawyers always wear high boots and short skirts? Is this a dress code?
