Just out of interest, how does one get the CPS to investigate whether an offence has been comitted and should be bought to trial?

Specifically, supplying false documents to a court.

Do you mean the Police to investigate and the CPS to Prosicute?

If the Police have investigated and the CPS advise NFA then you can ask to have the case reviewed by another CPS solicitor. As its surprising the differing views you get from different solicitors.

More a case in the public eye....

I was just wondering why the legal system wasn't bought to bear down with the same force on Brunstrom when he sanctioned false papers going to court and how a concerned citizen might ensure the legal system was being seen to be fair.

After all, if it's four months for falsifying one NIP, what should be the sentence for falsifying evidence against hundreds of motorists?

I just wondered what one would need to do to have it investigated. I'm willing to follow it up.

Well it would have to first be investigated by the police for criminal procedings.

So i guess first step would be going and reporting it. But im not overly sure.

You could write to the DPP asking them to investigate or even the IPCC. I think you would have more luck with the IPCC. And you can start a complaint online i believe.

6000 cases are being checked.

But that's just for letting the motorists off..... I was more interested in the perpetrator behind the scandal.... I shall do some digging I think.

You could look into bringing a private prosecution, but presumably you would have to be an injured party to do this.

Is this the incidents where the statements of camera operators were rubber stamped instead of being signed which is a requirement under Mags Courts Act?

If so then the evidence in the statements was not false but the statement itself did not comply with requirements so not admissable at Court.

DVD, they were not stamped, the signatures were scanned in on statements purporting to say the evidence was legal and true, when the officers hadn't even seen the evidence.

The actual case came from Pepipoo

The judge said he would refer the matter to the DPP if it continued. If the judge felt there were grounds for the matter to be investigated but chose not to refer it, why shouldn't I ask for it to be reviewed to see if the law has been broken?

If I was to submit a document into court with someone elses signature scanned on to it swearing it was legal and true I know the court would come down on me like a ton of bricks.

The case yesterday of the guy getting jail for filling false details on a NIP was the catalyst. I have made preliminary enquiries in an attempt to find out who should be investigating the matter.

The scameraships are very keen on the letter of the law being followed, if it's wrong to falsify a NIP, it's equally wrong to falsify evidence.

If a laser jammer could be considered to be PCJ, then so could this.
