As title really, a couple we know had a falling out, the Husband beat his Wife up, her face is black and blue, her front teeth were knocked out, this was a fairly unprovoked attack.
He was arrested and charged with ABH, his bail conditions say he is not allowed near the family home, my question is, what does a charge of ABH carry in these circumstances, thanks.

A decent amount of prison time one would hope.

The police have said they are going forward with this, they say it does not matter if the Wife backs out he will still go to court, which is a good thing because I honestly think she would have him back.

They have been out back in and she has a brace on, it will be some weeks before she finds out if they will take, then she will have to have all the chipped ones repaired, its a real mess.

Thanks sday, the trouble is I'm not really good at interpreting those sort of things, which is why I am asking on here.

So realistically he could get a community order, whatever that is.

I'm not a lawyer, but it sounds like sustained attack, not a single blow. CPS tend to pursue the lowest level offence that they are confident in getting a conviction for.

Without seeing all the detail, no aggravating factors, no mitigating factors, so Cat 1 or 2, 26 weeks min?

Even if it does get to court, bless the CPS,

Don't be so sure he will be suitably punished.

I know of a case where the guy was convicted on 2 accounts of ABH , plus assault on another 2 family members.

He got 10 months , suspended for 2 years, what a waste of time.

It was a sustained attack, he repeatedly punched her, then banged her head off the bedside table, when he let her go, she ran out of the house straight to our house, about a 1/4 mile through an estate in her p.j's in the early hours.
TBH her face was black and blue, but the size of the lumps on her head was what scared us.
The police say he claimed self defense FFS.

It gets even worse mate , that was 4 years ago , prior to my daughter meeting him., and we have just managed to get my daughter out of a relationship with the .
Police spent ages taking statements this time , even got a senior detective in to make sure the statements were bullet proof.
Police were positive they would get a result , then the CPS come along , drop the case and issue a restraining order preventing him to have any contact with my daughter.

Again , he sails away a free "man", leaving disaster wherever he chooses.
