Driving home today some tool pulled out of a side rd and I've smashed into the side of his car
my cars f#$ked
The bloke was dead cagey after the crash didn't seem bothered about his car n wasn't keen to go through insurance
He walked off after details were swapped (he didn't give insurance details just his name adress and contact number)
When I got home I went online and found that his car has no m.o.t or road tax but is insured
Do you think this will affect my claim ??

Tax and MOT shouldn't be an issue. A bigger factor will be whether the person driving is covered by the insurance.

Presumably your car's going to be written off now if you put it through insurance. Might work to your advantage, accept the pay out and get your car repaired.

I don't think the bloke would be able to afford it ,the damage to my car doesn't look that bad in the picture but the the drivers side front wheel has been pushed back and doesn't move in any direction when I turn the steering wheel
My insurance know about it because it needed to be recovered I'm fully comprehensive but am worried about losing my no claims if it turns out his insurance won't pay up

The fact he had no tax or test is irrelevant, provided he had third part cover in place it 'should' pay out.

It is very difficult for an Insurer to side step their RTA cover responsibilities.

Let your Insurers deal with it, that is what you pay them for smile

My advice is to accept a value you're happy with (which may or may not arrive in the first offer) and buy the car back (10-20% of payout). Then stick it on Ebay as a spares or repair. You will be able to sell it for more than you paid to keep it.

Depends on the damage, but that's possibly a cat C due to the value of the car.

Tax and MOT are irrelevant to whether his insurers pay up. And even if he's not covered by the policy they'd have to deal with it anyway so long as you can identify him (ie so long as the details he gave you are true), though it might delay things a bit.
