Benefiting from fraud
Discussion
Interesting one this and I don't think its been covered before
Well known figure on a large Subaru forum passes away with apparently no will, widow subsequently produces one that leaves everything to her and nothing to his children, then transpires that she has forged several signatures to produce this document, gets caught and sent down
Now it seems that some people think she can still benefit from his estate as being his widow when all said and done.
She started a large thread herself on the forum when he passed with gushing praise for him and how devastated she was, which quickly turned against her when the facts became known, its not an inconsiderate amount of money either, and I feel sorry for his children if indeed they do get nothing out if this, she surly can't benefit from her crime?
The fact she became pregnant with her Turkish lover before going back to court to possibly reduce her term also raises eyebrows

She isn't benefiting from crime, she is benefiting by the Laws of intestacy.
Yes true, I do get that, but the fact that she has committed the crime, it does seem unfair that she gets to benefitBegs the question if she was involved in her husbands death at all ...
Greed.
Wonder what attracted her to him in the first place?
What's the betting that as soon as the money is gone her new husband will do a runner - if he doesn't while she's banged up.
As for the 'Oh what a surprise, I'm pregnant' I'm with the Judge, just a cynical ploy to try & keep herself out of prison. Its the child - and her late husbands children - I feel sorry for.

She doesn't benefit from the fraud. She gets whatever ps he would have been entitled to anyway had she not committed the fraud in the first place, unless someone can find a real will. The difference the fraud makes is that she also gets some free accommodation, courtesy of Her Majesty.
The widow gets the vast majority of the husband's estate, harsh considering her actions regardless if that's the law or not as she was hell bent on getting everything, possibly should be a change to prevent her gaining control of the money and house on her release, but that's just wishful thinking on my part.

And yet his children get nothing, I realise life is not always fair, but thats a bum deal indeed.
How come? She will get the first £250K or whatever the limit is now if you die without a will and they will share the rest. If they get nothing, it means he left under the £250K limit so she gets the lot under the law anyway, so what was the point in her forging a will???I don't get it.

tty things like this or commit fraud per se.It's a million quid estate of a person who died intestate, not one worth less than the value (which is £350k or £450k gross, from memory) where the excess above the value gets shared out according to established rules.
I'd suggest that's why she did this - so she and her son got it all rather than just a fair share of it...

And - thankfully - she got caught out...

Its a shame it has turned out this way.
I had many a chat with the guy at the very early Subaru rolling road days over a cuppa between runs, when he would rock up with an extra 10bhp each time, just with a bit of clever fettling in his garage at home.
The sentiment exhibited in that SN thread is truly genuine, for a genuinely nice guy.
That's what makes it all the more sad to see his name linked to something like this.

If a person dies intestate;
The husband, wife or civil partner keeps all the assets (including property), up to £250,000, and all the personal possessions, whatever their value.
The remainder of the estate will be shared as follows:
the husband, wife or civil partner gets an absolute interest in half of the remainder
the other half is then divided equally between the surviving children
If a son or daughter (or other child where the deceased had a parental role) has already died, their children will inherit in their parent’s place.
So on a million pound estate the greedy b
h would have been guaranteed a MINIMUM of £625 grand and(depending on whether the personal possessions were worth a substantial amount) possibly close to a million!
Obviously this wasn't enough!
