Car being impounded by the police
Discussion
Hello all,
God I feel stupid, my other half has just been pulled over by the police, no tax and is impounding the car.
Here's the situation, purchased it from a dealership in November, there was a tax disk in the window which was valid till April 2015, so purchased the car, brand new mot, insured it, and that was that.
Until today.
I thought the fact that the fact the tax was purchased pre tax changes it was still valid, if the previous owner purchased the tax disk in the local post office, how would they get their refund?
Does this sound right?
Should the dealer of taxed it/told me/removed disk?
Thanks

The change in tax was October 1st.
I think you're going to be stuck.
edit- I see what you mean, as the tax was purchased before that date.
There's two parts, one is that from Oct 1st 2014, you wouldn't get a tax disc, and the other was the fact it wouldn't transfer over with the car.
It's an unnecessarily complex and awkward system, and it looks like you've been caught out.

The balance of tax will have been returned to the previous registered keeper automatically at change of owner. Tax discs are now completely obsolete and their presence or otherwise means nothing.
It seems very harsh, but I'm afraid it's your responsibility to know the rules.
Get it taxed and get it released.

I have never, and don't recall any other PC seizing a car for no tax? No ins/licence and unroadworthy, yes.
Great, trust me to get the one awkward one. It's insured, MOT'd, road legal and nothing at all wrong with it.He spoke to me on the phone, said something about "acting under powers of the DVLA I can impound the car"

He can, but he doesn't have to.Is your missus the RK? Surprised she hasn't been chased by DVLA by now as the car would be showing neither taxed nor SORN'd.
Dealer should have warned you about this.

It would be impossible for my mrs to rub anyone up the wrong way, she is so so polite, she was with her mum too.
At least the police gave them both and the dog a lift home.
How ridiculous - it must be obvious them it was a genuine mistake in unusual circumstances. What purpose is served by seizing the car?At least the police gave them both and the dog a lift home.

Was the April disc still in the window?
If so, I'd be a bit disappointed in the dealer leaving it there and not telling you it was void.
It was indeed still on display in the window. If so, I'd be a bit disappointed in the dealer leaving it there and not telling you it was void.
Anyway, car is taxed now, mrs and dogs are home, the car is tucked up in the compound and I'm £200 lighter!

There were 6 forces in the initial trial, now any force can apply for seizure powers form the DVLA.Those that have them find they are a useful "means to an end" - Cops are less interested in the tax issue, it just means they get a vehicle off the road that is causing other issues. It is a myth that the car has to be in the UK for 6 months now, if the driver is a UK resident (so, for example, has a job here or claiming benefits) then it needs to be taxed immediately, no 6 month grace period.

You really do come across as a nice & caring Constable, and I'm sure most are like you, but sadly not all.You will understand now, perhaps in a way, why I was so annoyed with DVLA when I recently changed my wifes car and the DVLA systems, all three of them, wouldn't let me tax it.
The system, as with most these days, appears to be a shambles and concentrates on people trying to live within the spirit of the law, like the op.
A simple mistake that doesn't require his car to be seized, he should be able to tax it immediately, at the side of the road via phone or internet, then left to sort out the back tax with DVLA at a later date.
Especially as the system has recently changed and it will take a while for everyone to become familiar.
