I p/x'd my car on March 17th via a main dealer and sent the slip to DVLA a day or so later.

The acknowledgement that I'm no longer the registered keeper came through a few days back and it says on it that it was printed on March 23rd.

I've come home tonight to a NIP from West Midlands Police for a speeding offence on the 27th March in a different city, at night.

What's the recommended way to complete the paperwork given I have no knowledge where the car was at that point other than knowing it wasn't mine?

I've called the main dealer to ask them what records they have of where it was, and from my POV I have the receipt from the main dealers (albeit the reg number isn't on it) and the acknowledgement from DVLA.

I'd prefer to get this right first time and the Police helpfully don't publish a phone number on the paperwork that they send.

Thanks in advance smile

Just send back the NIP, not filled in, and a letter explaining the facts.

Oh I'd assumed photocopies of everything, just didn't know what standard practise was as I've never had a ticket before, let alone for a vehicle I don't own smile

The dealers have emailed to confirm they shifted the vehicle on via BCA and to pass on their details (the dealer not BCA) to West Mids Police.

When this happened to me I wrote back to the Police saying I'd sold the car on x date and didn't have the new owners details. Never heard another thing.

There should a be a telephone number on the letter somewhere. Give it a call and explain the situation.

It's what I did when the same thing happened about a year ago. By the guy on the other lines reaction, it's a fairly common occurrence. I never heard another thing about it.

There isn't a number on the NIP but there is on the website, they were pretty helpful, essentially said what I thought which is send in the stuff you have - noticed they have an email address on their website so I've also emailed them though I think with the NIP being a legal declaration they'll want it physically posting back.

The dealership got back to me quickly (a poor sod on the parts desk got the phone call smile) and is going to check with sales tomorrow for any paperwork on the "deal file" that they can provide me just to show the reg number of the vehicle - I think this is just for my peace of mind.

Showing I didn't own the vehicle is simple enough, I just want to do my best to send off one set of stuff and be done with it.

Got to chuckle really, driving 20 years and my first ever NIP is for a car I don't bloody have! smile

In this case you don't need to return the NIP as it only applies to the Registered Keeper.

Fill in the form saying you were no longer the owner from *date* along with a copy of the purchase px form from the dealer for the car. blank out prices etc of course but that is all they need.

NIP will be re-issued to the dealer who will do the same to the person they sold it too or member of staff that got caught.

End of your worries.

This.

There's even a choice on the form to say you weren't the keeper at the time. I get quite a lot of them. That and congestion charge fines.

Don't send it back blank, i'm pretty sure you have to provide the details to the bet of your knowledge by law and can be prosecuted if you don't.

There is a specific space on the NIP for just this occasion, on the back you can fill in the details of when it was sold and to who. For good measure include a copy of the DVLA slip saying you are not the keeper and the invoice from the dealer and send it all off.

You wont hear any more about it - Mrs Buzz recently had exactly the same thing (despite her car being traded in 6 months previously)

You don't *have* to return it if you're not the RK, I've just been through the exact same scenario myself.

Whilst the form they provide doesn't necessarily have to be used, a person other than keeper issued with a valid s.172 request is nonetheless obliged to give any information which is in their power to give and which may lead to identification of the driver.

Tbh I've no intention of not returning it - I simply wanted to know the best way to approach it so I'm shot of the problem first go.

Not in this case... NIP not completed, no further action taken. The words "there is no legal requirement" are unambiguous.

The words they have used in your letter may appear unambiguous, but to read it as saying a person other than keeper has no lawful obligation to respond to a valid s.172 request is incorrect.
