Discussion
ive been told today all speed signs need to be lit 24hrs a day(not the small marker ones, the change of speed limit) and if you are caught speeding .. check the signs are lit at night.. if not, even if caught in the day time , the law states they have to be lit 24 hrs a day otherwise speed isnt enforceable??
does anyone know if this is correct, Ive been advise a case has been thrown out with this defense?

It isn't - some terminal signs are required to be lit, but only under particular circumstances and certainly not 24 hours a day.
Terminal signs on trunk or principal roads which are within 50m of a street lamp are required to be illuminated during the hours of darkness."14.54 Traffic signs must be illuminated in accordance
with regulation 18. Specific requirements for speed
limit signs are set out in Schedule 17, items 10 and

(other “A” roads) to be illuminated by internal or
external lighting throughout the hours of darkness
when they are located within 50m of a street lamp
(which does not have to form part of a system of
street lighting). It is insufficient to place a sign on a
lighting column; a separate means of illuminating
the sign face directly must be provided. However,
during any time overnight that the street lamp is
switched off, the sign need only be reflectorised
(i.e. the sign lighting may be turned off at the same
time as the street lamp). Even where the street lamp
is illuminated throughout the hours of darkness,
it is recommended that the sign is reflectorised in

Signs only need to be lit if located within 50m of a street lamp. If street lights are switched off the sign only needs to be reflective. Also, on local order roads (most villages) signs do not need to be lit.
If the sign if not lit during the day. It will not mean you can get off a speeding ticket!

A good question is “Does a speed limit with incorrect signage default to 30mph (assuming street lights) or NSL?”
I once spoke to an expert in signing regulations about this. He was adamant that if the signs aren't correct but the limit itself was established correctly the speed limit is still the same, merely unenforceable. So if you're accused of breaking a 40 limit with incorrect signage you say, 'but it can't be enforced because it isn't signed'. But, according to him, if you're accused of breaking the 30 or NSL you can say 'but there is no 30 or national limit there to be broken, the paperwork clearly says it's a 40.
