i got a parking ticker in November that I think I didn't deserve - it was a suspended bay right outside my front door, and I'm sure I wasn't parked in it. But I got a ticket anyway. So I appealed, and got a letter back saying "the parking attendant's notes say you were 5 yards from the suspended notice (i.e. in the suspended zone) so pay up..."

I decided that I wouldn't pay, and would instead wait and make a representaion properly when my £100 ticket came through, which it did a few days ago. I'm starting to get cold feet about it though. I don't mind going to court, but it will be a case of my word against theirs, and presumably in this situation I will lose? If this happens, will I just have to pay the £100, or will their be other costs too? Will they bother to actually go to court over this? any help, views, experince would be gratefully received.

I thought Parking attendents had to take a picture of the offence now?

Surely your word against theirs, innocent until proven guilty and all that?

If this is the case, I think it's their job to prove you guilty, rather than you proving your innocent???

It's not done in a court. so they only have to find in that it is most likely that you parked illigaly. It's not a fine it's a penalty charge, a fine has to be issued by a court when your found guilty. You have to take it to a parking adjudicator, if your already in it for the £100 why not go the rest of the way, they might back down...

Parking adjudicator has always been "fair" with me so far! I wouldn't advise against it...

Good nice to know! I am about to go down that road too.

RE Costs it does mention costs could be awarded either way but I think it said they would be mimimun amounts.

I am appealing one at the moment.

When i got the £40 notice, I sent it back explaining that the yellow lines were not legally marked.

They sent back something saying that was not a good enough reason and i should now pay up, or appeal.

I appealed and a month later got a bill for £120!

They 'didn't get the appeal in the post' :Rolleyes:
