A banned driver who was caught behind the wheel of a car with both legs in plaster has been jailed for six months.

Richard McAlpine, 47, from Glasgow, had never re-taken his test after being handed a five-year driving ban for a previous offence in 2006.

This is your third conviction for driving while disqualified and as such, there can only be one disposal here today.
Doen't ring true to me, unless the law has changed. As I remember it, the offence would have been driving without a licence, as the ban would have expired in 2011. What am I missing?

When he was pulled over and the police found he was already banned, he didn't have a leg to stand on.

Perhaps you remain technically disqualified until you reapply for a licence?

Or are the dates / reporting jumbled up? It says the offence was committed in May 2013, two years ago.

Expect the sentence was a total ban for 5 years & then allowed to drive under the terms of a provisional licence until passing a test at which point the ban would cease.

I suspect the original convicting court ordered this.

See Section 36 Road Traffic Offenders Act 1988 - disqualification until test is passed.

Not unless banned until test passed.

Badly written article ... edit: dates don't make much sense.
