Hi,

can someone help me please. I returned home this evening to find a letter from a certain parking enforcement company insisting that I pay them the sum of £500+ for incurred charges for a parking claim. This is for a matter they took to the county court and the day before the case, they cancelled. This is for a case going back to before the POPLA arrangements.

Is this viable, in so far as having made one claim in court only to close it, they send me a fresh claim for the same matter at substantially increased 'cost', making reference to Bevis etc.

Cheers,

DMN

If they withdrew the claim I hope you asked for your costs... And no they can't claim again for this - unless a county court judge allows them too. Which they won't (usually).

Basically they are trying it on.

No, you are not liable, they are trying it on (sorry, doing you a favour wink ). (You're supposed to void yourself and then pay up, do you not realise this??!? hehe )

If you could post this on PePiPoo (the information about the substantially increased pre-court costs post Beavis in particular) including a redacted scan of the letter, I am sure they would be pleased to read it smile .

Of course, Barry Beavis has leave to appeal to the Supreme Court; I bet your PPC didn't mention this? wink

Thanks for the replies. As I am sure you will appreciate, this is not a matter that received the most charitible of thoughts and vocab when I opened the letter.

They cancelled the matter on the day of the hearing. I had a feeling that they are trying it on. Would it be the local county court that I approach to confirm that the case was indeed withdrawn. If so, is there a deadline for making cost appeals because this has really pissed me off.

Thanks again,

DMN

Wow, they are really trying it on.

Usual protocol is if a Claimant discontinues at that stage then they pay the Defendant's costs accrued.

It should be noted that the rate for a private person representing themselves is £18 an hour.

If they were to file a claim again, the correct response would be to apply to the court to have the claim rejected on the basis they've already filed a claim already. Discontinuing the day before for no reason will mean they won't be allowed to file again.

Was the case discontinued or was it postponed or adjourned?

If so, I'm sure he would like to hear about your case.
