Responsibility for shipping costs - incorrect item.
Discussion
We ordered some mats that were supposed to be a 'tailor fit'. I assume tailor fit meant 'tailored by Stevie Wonder'.
However, the terms and conditions they pointed us to state that they won't refund shipping costs. Surely if the items are not as described, the store should be responsible for this too?

Yes! They are... They also probably expect you to lay down and take it up the... cos they know how much hassle it will be for you to pursue! However, the terms and conditions they pointed us to state that they won't refund shipping costs. Give it a go... SOGA and all that, if you have the evidence which can 'prov'e your order was not what arrived...
Assuming you're doing this under the Consumer Contracts Regulations, the retailer has to reimburse the lowest cost delivery option only. They are not obliged to refund for any delivery service above this.

I suspect you're dealing with someone who thinks the old DSRs still apply and the postage refund rules were different in that system.
BUT - when you say "tailor made" - does that mean made to your specification or just a claim they make for a generic product ? If the former, CCRs don't apply.

Cheers for the responses.
They claim the mats are tailor made for the vehicle (e.g tailor made for a Ford Fiesta mk2) rather than a custom item to our specs.
Basically they are slightly too large resulting in a central 'bulge' and the locator pins for the front driver side mats are out by quite a bit (two rear locators are out by 3") along with the mat being too long.
