Any one had this..

I had to SORN my wifes car becuase it had an issue that wasn't a quick fix.

I left it with the 1st garage to repair it..he couldn't by which time it needed to be SORN ( MOT ran out ) and he knew that.

New garage ( i didn't know it had been moved to be honest ) fixed the car but needed parts so they pushed it out in front of their unit for space to await parts..

DVLA came along and clamped it

the garage owner paid the release fee and he had to ask for his money in part back by showing trade plates and all that..

mean while I am sat at home with a cup of tea opening my post to a letter demanding £120 from the DVLA because I had been seen in my wifes car ( well not me the car was seen on the road ) ???

I have written to the DVLA to explain the garage was fixing the car to be able to get an MOT again and therefore Road tax?

now they want to take me to court.. I wouldn't mind paying the fine if I had personally done some thing?? I hadn't ?? go to court and present my case?? the release fee was paid for by the garage!! I asked them to look at the name and address given for this and they refuse to look at it..

DVLA popped into the garage and proceeded to clamp your car without anyone saying 'hello, do you realise this is private land?'

I doubt that.

Court already? When did this happen and how many letters have you ignored?*

* oops, my mistake, this is PH where nobody ever gets any letters at all, apart from incorrectly addressed ones to former occupiers of their home from the bailiffs.

they have sent letters

we have responded to each and every one of them

they have been presented with the facts and yet they chose to ignor them.

So now we have a standard letter asking for money or court.

I am gearing my self up for court. Because of one thing... I didn't act out side of the law.

So you need to get a letter from the garages saying that they had care of your car within x date and x date.

DVLA produce document that says your car was seen somewhere between those dates

Its not really your problem, its the garages if they weren't displaying correct trade plates

Take it to court, present all your evidence, make them look stupid and claim costs.
But they will probably back off before it actually gets inside the court-room.

Re the bit in bold, the 1st garage should have passed on that information to the 2nd one. If the DVLA won't back down and the county court judge (this will be a civil debt claim) finds in their favour then you'll have to cough up and try to get your money back from the garage. They parked your vehicle on the public road without your consent.

It's all a bit catch 22. If it does go to court and you lose, the claim costs will add to the £120 penalty. Do you gamble on the DVLA seeing sense and dropping the action, or do you try and prise the penalty sum out of the garage now so that you can head the DVLA off at the pass by settling the penalty before any legal action begins?

A complete ballache either way. Hope you can get it resolved before it gets out of hand.
