Missus has just called to say that she has had a prang on teh way to school.

Single track lane, she stopped and tried to reverse but the van coming up teh road couldn't stop in time and has hit her head on. Damage to bumper/lamps/bonnet but fortunately no injuries to her or the kids.

I've told her to get his insurance details (its a Badger rental van) and to give him ours. She got his name, and I said to take photos of car/van etc but she says he has already moved the van back 10-20m

Anything else she should do straight away?

Told her to take pics, hopefully she has.

What do we do next? Contact Badger Hire to get their insurer to sort it out or do we have to involve our insurer? We've got the driver's hire agreement number from the paperwork he had.

I would get his name, address and phone number.

His insurance details

Even though he has moved the van take several photos including any damage to the van,

I would also ring the badger van hire company to inform them that their van has been involved in an accident with your wife. They may confirm that the name the driver gave your wife is correct.

Ring your wifes insurance to tell them what has happened but they may only talk to your wife until she gives permission for you to deal with it.

It looks like the van driver may have been going to fast to be able to stop so would be a no fault accident for your wife.Has he admitted liability and even if he has he may change his story.

If there are any witnesses get their name and phone number.

If the other parties insurance admit liability get them to give you a hire car and repair your car as they will be keen to make you happy as it will be a lot less expensive for them than if your insurance get their Accident Management company to sort it out that could also cause you problems with the claim.(plenty of threads on here about this)

She's going down to the hire place's office (it's a local hire company, not a national chain) to see what they say.

I could answer this, but you won't like what I'm going to say, so I'll leave it to flemke and a few others to tell you what you want to hear, even if it is wrong.

Er, thanks for that. I think.

I imagine you are going to say that the Van's insurers will say it is knock-for-knock and that we are going to have to claim through our own insurer. We will then be stung for our excess plus loss of no claims and increased premiums.
TBH it is what I am expecting. I expect the van driver will have second thoughts about exactly what he will say happened once he has a chance to think about it a bit more. He might not though, as he'll have to cough up the £250 excess on his insurance either way.

This sounds like it will go 50:50 to be honest.

Knock for knock ended in the 1970s amd had nothing at all to do with assessing and agreeing liability. It was an accounting process to remove the need for unnecessary and expensive processes to recover money and pay money out that often had a near enough net nil end result.

If you mean 50/50 then yes, I am going to say that.

I'm guessing it will not go well for OP's wife regarding insurance...unless I've misunderstood she reversed and therefore meant the van behind her didn't have enough space to brake? How quickly did she reverse? Was there any warning that she was going to reverse?
You've misread it completely

I think it's more a case of is there any evidence she tried to reverse if the van driver doesn't support that chain of events?

Do I do what? Explain what knock for knock actually is? How "dickish" of me to explain something?

Do you write posts like this to see how much of a cock you can be before someone calls you a cock?

Sounding positive so far.

Van driver has reported accident to the hire company, so they know his version of events.

Manager at hire company has contacted the bodyshop he uses for repairs and has said to mrs to take car to them and they will quote him for repair, including a courtesy car while they do the work. Not sure whether he is going to use his insurance or not, expect it will depend on the cost.

So she's off to stick some gaffer tape over the broken headlamps and bumper and drive it down to them to see what they think.

The van hit the front of the OPs wifes car and was driving towards her.If you are going to post on a thread it may be best to read it all first.

You must know (at least a truly hope so) that your tone is condescending, pompous, arrogant and ish.

If you didn't have info that was of use to people they would tell you to crawl back under your stone.
As it is, you do so the toll that people must pay for your experience and knowledge to have to tolerate you tone and pathetic behaviour.

Your reply tells it all.

ETA. Sorry for butting into your thread OP. Hope you manage to get it sorted out ok.
