I sent off to the DVLA my SORN in December as the vehicle wasn't going to be on the road. I then taxed it in January like nthe responsible citizen that i am.
Last week I got a letter saying the DVLA were fining me for not re-taxing my car and when I protested they said that they had no knowledge of the SORN declaration.
I'm not paying £80 when the sodding postie screwed up, so whats the best route forward?

So the car tax expired Nov 2004.
You SORN to cover not taxed in December 2004 on.
You relicense Jan 2005.
Looks as if they did the month cull on unlicensed/unSorned vehicles of December before you re=taxed or they got the record of it..
If you did send off SORN by post write back again (politely) point out that you carried out the procedure as they advise on their site by posting said form. It is not your fault that they have no apparent record and as the form was sent it is their mistake not yours hence the fine is inappropriate.

A way round the SORN nonsense is as follows:
1 After you have written another letter telling them that their records must be inaccurate , if they persist, ignore the DVLA. However when you try to tax it the Post office will want the DVLA 'grab' paying. Thats how they get you.
2 Transfer the 'registered keepership ' of the car to a trusted friend. This does not confer legal ownership. Send in the forms to DVLA. Your friend gets a new logbook. When you want to re-tax it pay him to do that. the SORN 'grab' cannot be imposed on the new RK.
3 Sometime later re-transfer the ownership back to yourself.

If not,sounds like they win, sorry as the way I understand it and am prepared no doubt to be put right is that you have a 14 day period to declare SORN, by the whatever means on the reminder. On the 15th day, if not received, thats it !!

Good advice - thanks all. I did send the SORN back in early december saying that it wouldn't be taxed for Dec but then I trotted into the Post office in Jan like a good girl and sorted it straight away.
Interesting to know the whole postie issue. I had a nightmare last year where my post didn't turn up for 3 months. I then had to contact everyone who writes to me (bank, Gas board etc) to tell them that I hadn't moved address as the divvy so and so who recieved my post sent it all back saying "Not known at this address"
I complained 3 times to the post office and never got a response. Probably couldn't find where I live to put it through the door.

Sounds like it's up to you whether you want to take the time off to see it laughed out of court or to pay the fine..
