Insurance claim problem
Discussion
A few weeks ago had a minor RTA where a truck rolled / drove into the back of me at a set of lights.
Quick scenario, I was waiting at a set of red lights 3 or 4 cars back on the inside lane of 3 lanes, directly beside me in middle lane was an artic with trailer, there is a gap in front of us between the cars in front because of a keep clear section for a minor cross roads. An Ambulance approaches from the rear with blue and twos going trying to get through between mine and the middle lane, so middle lane is trying to move to the right and my lane is trying to go left, most cars going up the kerb, I can’t do this as I have a lamppost right beside me so I move forward and right into the middle lane in front of the truck and stop in a space in front of the keep clear zone, (the lorry had not used this space quite rightly because the trailer would have straddled the keep clear zone) all this time the lights are red so nothing is really moving forward, as I stop the lights go green, still 3 or 4 cars in front so back where I am nothing has actually started to go yet, so just about to pull away probably a second or two after stopping and the next thing I know, bang, the lorry has driven into the back of me.
Driver gets out full of apologies, admitted he pulled away anticipating the traffic moving but without checking the space that was there a few seconds earlier wasn’t any more.
Went through all the normal swapping details etc, so to cut a long story short, not going through my ins company as my excess is about the same as the damage, no damage to the other vehicle, sent everything to the other party (a large well known haulage co)as requested including 2 estimates. 5 weeks later can’t seem to get anywhere despite numerous emails and phone calls, just being fobbed off. Anyway yesterday received an email from their ins co now refusing the claim, they apparently have cam footage which in their view shows their client not be at blame, quite how they could reach that conclusion who knows, so I am gobsmacked to say the least, it’ gets better........ spoke to them this morning asking them if they would kindly send me the footage and they are refusing, their stance seems to be ‘take us to court then’ so a bit stuck now, where do I go from here, any views?

Wow. Two threads in a short space of time about insurance companies not paying up. Both from longstanding members with negligible post counts. Totes amazeballs.
If there's a grain of truth in this, then the OP should use his own insurance company, or an AMC, or go to court himself. It's not difficult.

Should've done it from the beginning but ring up your insurance company! It's what you pay for insurance for.
No it isn't, no amount of your premium goes toward your insurer acting in a claims management capacity when you have a 3rd party claim, if anything you get a discount, because when you do involve your insurer, they will pass you on to an accident management company, and receive a referral fee.Going to your insurer is usually the easiest, but it also gives you the least control over how the claim is handled.
Gosh, a lot of conclusions being jumped to here. reported it to Mr Direct line on the same day so they have it on file just in case the other party tries to say the front of their lorry was destroyed, took photos which show no damage which they also have, to date no claim has been made by them to my ins co.
Loon, just when I think you are chilling out you start behaving like a cock again, I could take a photo of my bumper, and post it for your benefit, but you know..... I can't be arsed.
Thanks so far for the helpful replies

If your story is to be believed, a lorry drove I tot he back of your car amd did a very small amount of damage, let's ignore how much damage a lorry would do, even at walking pace. Direct alone have this claim logged amd haven't offered to act for you, or to refer it to Quindell for them to deal. I'm really struggling with that. On top of this, the TP insurer has video of their driver driving forwards into your stationary car and causing damage is being used by them to reject your claim. There's either no accident, or a whole lot more to this story that we've not been told.
