A colleague of mine who is 5 months pregnant was driving home a few days ago and went through a huge flood under a railway bridge. The result was the power steering failed and the battery light came on. (the drive belt had come off). She continued for a short distance and parked just over the to of a small rise. Its a people carrier so it was perfectly visible, however as recovery was going to be delayed she informed her insurance company and the local plod it was there and left it until the following day. aT 7 AM A TAXI ran in the back of it and wrote it off. When she arrived to see the car at the repairers the police had had it moved to she found a fixed penalty notice on it for parking without lights.

The notice is dated correctly but a year early 2004

What would you do to get off with it? plead the wrong date or that the police had been informed and accepted there was no danger?

The fact that the date is wrong....doesn't mean the ticket isn't valid.

If the police officer saw the car parked in the circumstances at that time, the details will also have been entered in his pocket book.

However, in the circumstances; ie: the electrical problem with the car following the puddle; a letter should be wrote explaining this. I would think that the ticket will then be quashed.

If not. I think she should plead not guilty and let a magistrate decide.

I think she wont have anything to worry about.
