Hi all,

So I had a sim only contract with Three. I spoke to them back in August to upgrade it and it changed to a 12 month contract (My previous Sim contract was rolling) - The chap on the phone said I had 14 days to cancel it if I wished to.

A few days later EE offered me a better deal so I called up Three to cancel everything off and get my PAC code. The guy on the phone said all was well and cancelled and I would be charged a small fee for any usage I had out of my plan.

Fast forward to yesterday and I check my bank statement and that "small fee" has actually become £187.93?!?

Spoke to Three today who said that the charge was incorrect....and it should actually be £290?! Apparently a cancellation fee is due BUT the issue is when I initially cancelled the lad on the phone made NO mention of this charge. I specifically asked him if I would have to pay for the cancellation and he repeatedly confirmed "no".

I'm waiting for a callback from 3 to resolve this but I want to know where I stand on this? I am NOT willing to pay almost £300 for a contract that was cancelled 1. within 14 days and 2. with confirmation from the telephone advisor that I wouldnt get this charge.

If I claim indemnity from my bank and get the money returned to me, where does this leave me? Or are there any other suggestions you can reccommend?

Seems like an eff-up that'll be resolved.

Wait and see what they come back with.

They'll have recordings of when you took the new contract, and cancelled, so failing all else ask for those.

You'd probably need to take them to small claims court, however do you have any written proof or recordings of your own?

You could under the terms of the Direct Debit Guarantee.

You just call up, and the money is back within 24 hours, I've done it myself.

Proceed with caution though. The issue is you have a credit agreement with Three, and they may update your credit record with missed payments or a Default, which would make this situation a lot more difficult.

I'd exhaust Three's own procedures first for this reason.

If you cancelled the contract within the 14 day cooling off period I would have thought they would only charge you for the few days of the new contract.

You must have a more expensive/better sim only contract than me.I have a iphone,12 month contract,300 data,300 minutes and unlimited texts for £8.92 per month but even so three wanting £290 from you is taking the mickey to say the least.
