what penalty to expect?

Ah, it couldn't happen to a nicer person.

A dear friend of mine (read complete a$$-hole) has been done for drink driving. He hasn't actually 'fessed up, but I have my ways of finding these things out.. mwahaha..

According to the documents that he rather carelessly left lying round for me to find () he has been arrested and bailed to re-appear at the station in March.

His breath results were 50ug and 45ug (yes, I know thats not the right symbol ) while the limit is 35ug.

What penalty can he expect to receive for this? Will it be slapped wrist and fine, or will it be loss of licence?

While I hope they throw the book, printing press and author at him, the outcome of this will possibly have quite a big effect on my husband, so we are quite eager to find out what we can expect..

i thought that if you were caught over the limit that under the the d+d laws the punishment was a year ban (min) and anything from £200 upwards for a fine.

Should be a 12 month ban and a B level fine (one weeks gross income) less a third if he pleads guilty.

hmm, while on the one hand it is completely deserved - (I had a night out with this guy and was matching him drink for drink while we had a meal - he was drinking pints while I was on smirnoff ice.. he then drove us to drop off the car before we got a taxi over to the club we were going to. It was only the next day I realised I had had 5 bottles of smirnoff ice so he had had 5 pints needless to say if we go out now, I drive!) - it will have quite a bearing on my husband if the guy loses his licence. Guess we will have to wait and see what happens in march :S

He had the blood sample taken (his sample was in the sealed bag with the breath results)

50ug to 40ug..is quite a drop and it's coming down...

So depending upon when the doctor arrived...there's a chance he might be under the limit..

The limit on blood is 80.

I would expect that if he gave a sample of 45ug% and his bail date is in March, then he has probably opted to replace the breath reading with a blood reading. DD offences which are evidencesd on breath are ususally in court within a week!

This long bail date suggests that he has given blood and that analysis will take that long for the reult to be posted back to the OIC (Officer in case).

I think he is done for!

He stands to be banned for a minimum 1 year and fined depending on the circumstances (whether 'driving' or 'in charge' as 'in charge' is discretionary disqual, 'driving' is mandatory) of his offence and whether he employs a good solicitor
