Basically I've bought a used car from a franchised dealer and upon buying the car they said if I pay them the cost of the tax on collection they will tax it for me.
I pick it up a week later as they needed to sort some bits out and give myself time to sell my current car.

Now I ask to pay them the tax so they can tax it to be told they can't as they don't have the v5, the car is undergoing a plate change and they've sent the v5 off is their excuse. They've assured me I'm ok to drive the car until they send me the v5 but with the new rules and that I'm not convinced.

Obviously I can't sorn/ tax it or anything without the v5 /new keepers slip.

I'm not driving it to be sure as it must be untaxed, but can anyone confirm this is right?

Thanks

Go on the DVLA website and check the Tax status of the car

Officially it wont be taxed as when the ownership changes the tax is refunded, it's also highly unlikely that it's taxed at the moment unless the previous owner still has it registered in their name.

It is showing as taxed until February, but I thought the new owner had to tax it upon purchase?

Where would I stand with the dealer if it isn't properly taxed?
Surely they have a duty of care to make sure it's driven off legally?

Some will say risk it, other wont

I'm in the wont camp for 1 reason.
When the V5 is signed and sent off, it should be backdated to the point you bought the car. I don't know of anyone who's been fined retrospectively but it would 100% leave a period between purchasing the car and you taxing it.

Others will say sign and date the V5 with the date you actually sign it and then that wont happen.

Its your choice at the end of the day.

I'd be leaving the car at the dealer until they have the V5 back

Nope, that's the responsibility of the person driving it.

You're right, this would suggest to me that the old owner is still showing as the current owner. How long do they say they have had the car?

But I can't physically tax it without numbers off the v5 despite wanting to, they agreed for me to get the car day when it was impossible to do so legally?

I don't think they should have let you take the car.

What plate is on there? the old plate or the plate they think will be reissued?

most of the time it'll go back onto that but until they've received the new V5 etc back then they just don't know that!

Keep it off the road, wait until they call you and then go sort out the v5 and tax

Or call the DVLA and ask them exactly what to do.

I've been back to the dealer and they've categorically told me I'm ok to drive it until the v5 is delivered to me, could take about 6 weeks.

Does this sound right?

No - Something stinks to high heaven here - A soon as the change of ownership is registered, it is untaxed.

I wonder, are you dealing with a lone salesman, try speaking to the Dealer Principal. Are they part of a bigger group maybe? (I have known of salesmen, working unsupervised, to cause chaos!)

I think he's trying to say it's still in the other guys name so doesn't matter, but as you say I don't think it's right.
A salesman sold me the car and a different person dealt with me when I collected it, they bought the same second guy out to confirm it was fine when I went in earlier.

They are a franchise, ford if I'm allowed to say.

I don't know what to do, they're just gonna say there's nothing wrong every time I go in?

Once the DVLA effect the change of keeper, your vehicle will show that it's untaxed. Then there will be a period of time between the DVLA issuing the new V5 and you receiving it where you won't be able to tax the vehicle either.

The easiest way would have been for the dealer to use the online system to take the reg plate off the vehicle which is done instantaneously. Then they could still use the old V5 to send off the name you as the new keeper and you could tax your vehicle using the new keeper slip.
