SORN'd car on the road?

Just a couple of questions:

My 'B is currently SORNed as she failed her MOT and the tax was due 1/1/05. She's currently in a mates shed being rebuilt. Now, I understand he/I can drive the car to a pre-booked MOT test-station (once the work is done). I also assume that she can be driven back (pass or fail). If she passes, can I also drive her from the shed to my house before getting the new (free) tax disk? There's no post-office between his shed and my house. If that's slightly dodgy, would carrying all the documents and claiming I was on my way to the nearest post-office to get a tax disk be accepted?

To or from a pre arranged MOT test is ok.
To or from a place of repair is ok.
Once it has a ticket then it must be taxed, and having it on a road with no tax is an offence.
You technically can be reported for the offence and dvla could issue a fine which you can mitigate or get written off by the fact you got the tax same day.

As to if you would be reported is a matter of discression, i have stopped cars with no tax that have had all docs and the cheque and the renewal form and have let go as the driver has stated they are on their way to get a tax disk.

Good summary from Slider.

Bear in mind also that providing the only thing wrong with the vehicle is that the Excise Licence is out of date, then it is not a "POlice" offence. Bib, under these circumstances, will report it to DVLA who instigate a prosecution if necessary.

So if reported, Bib sends his little form off to DVLA .
In the meantime Sheepy you have nipped in and taken out a Licence. When the Bib form arrives at DVLA and is processed, surprise, surprise, your record shows Licence taken out. Very, very doubtful they would persue it further.

A warning. Bib may well also report you for failing to display a Licence, but if DVLA don't prosecute then normal for BiB to NFA that. The warning is that if you park up and get a FPN from a civilian Jobsworthy for fail to display you will have to pay - all none points gathering stuff.

Don't worry - all the BiB's are off traffic work - if a bl@@dy camera or computer can't catch you, the government aint interested.

Incidenttally, with the new fine first ask questions later approach from DVLA, what if you are on holiday for three weeks? As someone who has NEVER driven untaxed I find the new guilty by default damned insulting. About time they charged you by direct debit monthly.

Thanks guys. Just wanted to understand the situation a bit better. It would be just my luck to get stopped whilst driving the car home! Looks like I'll have to do some sort of multiple car shuffle to get the new MOT certificate off my mate (once the B passes), get a tax disk and then go and collect her from his shed.

You could always leave the B in the MOT place's car park while you nip off for the tax disc, then come back and pick it up

Yeah but if BiB were to do a PNC check then the sorn would be shown as would expired tax.

If i PNC a vehicle and it comes back as SORN or VEL expired it's getting tugged.

ANPR will also show SORN or VEL expired.

But only if the records are up to date! How many times does the DVLA fail to update when they should.

From what i can recal dvla records are updated every 2 weeks ( i know in this case the tax may be a day out ) but SORN will show on dvla databases and pnc after 14 days.

But it is still grounds for a tug.

Even if the data is incorrect the sorn will still show. And he could get tugged.

The DVLA database has vastly improved for policing in the recent months and i mean VASTLY improved.

End of the day with regards to this thread Q, i think he would be ok in reality. Its the pisstakers that will get the fines.

We all know the public side of DVLA databases need vast improvement, but our side is sooo much better as vast amounts of cash has been put into ANPR systems, and if they were that in accurate it defeats the object of the system.
