If any motorist that I deal with doesn't want a fixed penalty, they can elect to be heard before a court..

The fixed penality is offered to the driver as an alternative to a court appearance.

If the driver doesn't wish to partake in the scheme, they can have their time in court, with a loss of working day, waiting around at court, potentially more points and certainly court costs...

Exactly....if it's unlawful for you to issue fixed penalties, the Court system will collapse.

Unfortunately that is all to true - the system is heavily stacked to make people role over and take it on the chin - even if they are innocent.

If the driver is foolish enough to attempt to try and proove their innocence it is a lengthy and costly procedure, even if successful the courts will not cover the driver's legal costs, loss of earnings etc....

And if they are unsuccessful the punishment is steeper than the original penalty - justice blair style.....

As for everybody electing for a court hearing.. In the UK .... I'm afraid co-ordinating such a thing would be impossible....

All that needs to happen now is for everyone to abide by the speed limit for a month and the majority of SCPs will run out of cash, but we can't even do that..

But that ist our right - Liebchen - und it would be one heck of a protest. It might led to right kind of tolerance und death of PC Gatso...

We did have a "starve the cameras" campaign... but they would adjust to 31 mph to keep the dosh flowing

On the other hand - we could create total gridlock by crawling around at 15 mph - but we do that on the motorway most mornings

Not quite, it needn't be as drastic as actually complying with speed limits. All you need to do is avoid getting caught.

Surely two different penalities for the same crime
i) offer
ii) court appearance
has to an infringement of some huamn right legislation. I can't see the fairness in being punished more severely just because you wanted your day in court.
