Evening all, I was stopped by plod tonight as he wasn't happy with the manner in which I joined the M25. I joined Northbound from Thurrock. I accelerated briskly from traffic lights up the slip road, never passing 80mph. It was quiet, except for one car in the inside lane, so I joined behind him, signalled and nipped around and plod lit up behind me.

Anyway, hard shoulder and a few polite words and an alcohol test, and all was well. He'd asked me if I'd received a s.59 previously to which I told him no. He said if I had and I received another my car could be seized. Fair enough I thought, all stuff I'd heard before as a driving/car enthusiast.

I have no criticism of the Officer. He was very fair with me as I did break the speed limit joining a quiet motorway. I'm just not sure if I now have a s.59 issued against me. He didn't say I had, but I felt it was implied.

Is this something he would have to make explicitly clear, and maybe even provide a proof of?

Anyway, good on him, glad to see Traf.Pol doing their duty.

Down here you would have some paperwork to take away with you. I would think other forces are the same.

Up here (for the Scottish equivalent of s. 59) you don't get any paperwork to take away but the driver and RK do receive a letter in the post explaining the circumstances.

have a read, but your 'story' doesn't seem to tie up with s59 issuing.

I was given one - I didn't get any paperwork at the time but had to visit the police station the next day to pick it up. I've still got it somewhere, although the "offence" has long since expired.

Thanks for the thread link. I never realised before how easy it would be for them to abuse this power.

In my case, I simply accelerated quicker than your average motorist. I was at the front of the lights so how is it an issue? I caused no harm.

If it was my speeding he was unhappy about, well that's a separate offence.

Anyway, I don't think I was actually s.59'd, but it's all food for thought.

Wasn't there something about a guy in Scotland being done (S.59/DWDC?) for 'harsh acceleration'?

The ridiculous powers given to the police to deal with non events are frankly quite scary...

Both ones I've received in Scotland have come with paperwork at the side of the road. A copy for me and a copy to give the new owner should I sell the car within 12 months.

Also followed up by a letter in the post.

Probably thinking about the thread where my mate was given a fixed penalty for harsh acceleration.

Ended up with CD20 on his licence.

From what you've said, it seems fairly clear that you haven't - but if you'd said yes, then you'd have been having a much more serious chat. Take it as a subtle hint, and don't expect any kind of leniency if you come across that particular guy again...

Out of interest are you under 25 because if you keep getting stopped and the police mention section 59 mayb it's time to think about how your driving. I am a car enthusiast and have been stopped for speeding but never have they said I don't like the manor of your driving and think section 59 would be appropriate. If you read the act you are either causing nuisance at none legal car meets or your driving would cause alarm and distress to other people.

If you get one or have been issued one if you get stopped again it's bye bye car.

The M25 at Thurrock is currently under a 50mph limit on all entry and exit slips due to the poxy roadworks that's going to jam it all up for another year.

I'd say you've had a result.

Yes, you're right! Went through there again today and realised it was a 50mph slip road! eek

Bloody hell!

And no i'm not under 25. I'm 28 with clean license. I was driving home from my Dad's on boxing day evening, not attending any meet. Clearly I was taking advantage of the quiet roads.

When I do attend meets I am on best behaviour. I agree I was lucky this time, and I'm grateful for his leniency.

In other news, woke up to a cracked windscreen today. frown Merry Christmas and happy new year!

Looks like you were Lucky the. 30 over the 50mph your observation skills could be sharpened maybe IAM could be part of your New Years res if your serious about your driving and being a car enthusiast and not - boy racer.

It will show how to observe and when to go slow, I am not religious about limits on the open road. If you get a good observer you will learn much better overtaking techniques and how to balance a car through a corner so when you change direction at speeds, police don't have reason to believe your driving would cause others alarm and distress.
