Hi Long time lurker first time poster on here I have this court case coming up In a few weeks just looking for a bit of advice on what to say while I am in the court . I will be pleading guilty as I was speeding although I don't agree it was exactly as fast as stated it was fast and still above the legal limit and I'm not going to argue the toss in court over around 10mph as its not going to help anything and I want to get it over and done with and walk out on the day with the lowest possible punishment as whatever I get is going to affect me through insurance costs and the record on my licence or possibility of not being able to drive for some time .

So my questions are
In your opinion what am I most likely to get ?

What should I say in court as I need my licence for work (mobile technician ) I have recently started a new job after being made redundant from my previous job and struggled to get this new one as I was out of work for 3and a bit months and could end up back in the position of being jobless again , my boss is willing to write a letter as they need me to be able to drive and it's going to effect the company insurance (especially being a small and fairly new company )

I was speaking to someone a few weeks ago who got 6 points and £560 fine for 50 in a 30 on a industrial estate on a Sunday around 4pm am I likely to get the same punishment or a harsher /more lenient punishment

The offence was In February of last year (Feb 2015)and I have not received any more offences since this one and my licence is currently clean and always has been clean this has been my one and only offence in 8 years of driving will this be taken into consideration and help my case

As much help and advice as possible would be very welcome and greatly appreciated and most of all I will be going suited and booted

In the vehicle details, the type/class box is filled in as SDP. I'm not sure if this is an error, mistake or the guy has noted your insurance cover there, but if you do have Social/Domestic/Pleasure, it might be hard to argue that you use you car for work as a mobile technician.

Did it really take an hour and 50 minutes to stop caution and charge you and record the speed as 60 mph when further up on the ticket your holding it states 100 mph? Also replying I didn't realise I was going that fast leads you right into a Section 3 RTA 1988 offence of careless driving.

I don't know what that bit is about that was nothing to do with me that's on a totally different road about 10mins away from where I was stopped must of been his next victim that night after me ?
And yes I kind of realised that after what I was trying to say was I wasn't going as fast as he first said because at first they tried saying I was doing over 115mph which I knew I wasn't and denied that at the time but at the time I was crapping it at first so didn't know what to say at first when they was throwing a load of questions at me I thought he had a reading of the speed on a speed gun and didn't think they could just estimate speed and acuse me of it straight away I was proper sh**ing it and didn't know they would write down one comment and take it out of context

I was never shown any evidence of my speed and they never showed me a reading like on the tv programs even after denying the speed I was accused of I believe they just estimated my speed as they was playing catch up

surely that is irrelevant as he appears to have been stopped at the time unless it;s the 6 month to lay charages bit ...

You've confused the section 1 requirements (warning at the time or notice of intended prosecution) with the requirements pertaining to commencing proceedings. It's extremely relevant that the written charge and requisition were issued within 6 months of the offence date. Charges are not "laid" where the requisition process is used. You're thinking of the summons process - which is irrelevant here; see thread title.

OP - if you do plead guilty then you won't have to try too hard to win 6 points. The basis of plea must be made clear. The fine is dependent on your income and subject to a maximum of £1000. I may post something later.

100 in a 70 in snow and wet near freezing...

Anyway, if you want to blank your plate out, you might like to note that it's in the last image, too. Well, something vaguely approximating a plate is, anyway.

Oh just noticed that where it says index number that is actually my post code not my number plate so they have got that bit wrong there

Yes it was cold but there was no snow on the road it was wet out but not freezing I had already being driving for 20miles odd so had a good feel for the conditions and the snow I don't know why they wrote that down as it only started when I was in the back of the car so after I had been stopped and it was more like sleet and never settled the whole night it was just typical British late January crap weather
I know it was still a stupid thing to do though but I have seen a lot more dangerous driving on the roads in the middle of the day when they are packed , the roads were deserted so had the worst happend I would of only being hurting myself it was a dual carriage way with barriers btw

A question for agtlaw. Is the police officers witness statement defective?

- Massive time difference (nearly 2 hours) from the TOR.
- Also a different road/location: the B530 at Houghton Conquest is around 2 miles from Elstow - https://www.google.co.uk/maps/@52.0852713,-0.47811...
- And the icing on the cake: Item 1 of the charge has an incorrect VRM (i.e. a postcode).

Could all that be sufficient to get it thrown out?
The ground being that the officer's paperwork/evidence is questionable/unreliable?
Perhaps two different people/offences have been conflated.

Not trying to excuse the OP. Just asking...

Yes. In the officer's statement he writes some unrelated stuff after the question about video evidence. After that it says Comment: but the comment is redacted. I just wondered what it was.
