hello all newbie here
got a nice letter through the post today from the chehire constabulary. basically was caught doing 38 mph in a 30 zone coming out of a 50 zone. was caught by one of these mobile vans, now from wot i remember of the incident the van looked like any other white van from a distance and was parked at the side of the road in amonst a row of cars. wasnt till i passed it did i realise it had the markings of the constabulary and the neon stripey stickers on it, the van was parked on its own with no other police vehicles round it and no one in the drivers seat.basically wot i wanna know is, is it worth argueing the toss with them over it or should i just take my punishment and help fund the constabularys xmas shindig?

Afraid you dont really have an argument on this one.
It appears you were just on or over the forces speed level for prosecution at 38mph.......and with the safety cam vans (as our force calls them) they usually advertise the locations of the vans in advance in the local papers. I believe this gets round the requirement to have speedcam signs posted.

Hi,

Sounds a bit petty - 38mph after a 50 is a bit tame (their threshold must have been right on the 35mph 'lets make some money' point).

At the very least you'll need to determine if they have real evidence or they are fishing.

Real evidence is the type that stands up in court.
If you go to court then it will slow down their tax system and give you useful inside knowledge of a courtroom. Magistrates (sp) get done for speeding too so expect a fairly balanced judgement.

The ACPO guidelines are 10% + 2mph over the limit is where enforcement STARTS, so in a 30 zone, this is 35mph and up.

Again, the guidelines are that the vans should be visible etc etc, but they are only guidelines.

Sounds like you'll just have to take it, I'm afraid.

so does this mean if there was no speedcam signs up on the rd they would have to make the public aware of the trap in another way i.e in the local paper? just asking because i wasnt local to the area i was caught in so would not read the local paper!

how could i find this out according to the letter i got, i can only ask to see the photograph or the calibration for the camera if it went to court. i thought by law you could see the evidence or calibration certificates if it went to court or not.

The guidlines dont really mean anything, they can do you for 31 in a 30 if they so wish. All the visability and signage guidlines means, is if they meet them, they get to keep the money generated to fund themselves. Mind you, they are safety partnerships, not revenue raisers - honest! lol

Ah the cheshitire stabulary. Yes well these particular scum are scared of solicitors. Have a look on the ABD site and they have a guy advertising that will make it go away for you for about 300 quid. I think they use the Hamilton so make sure u are insured for any driver.

Ticket is £60.
Unless on 9 points, £60 is the better option i would have thought

I would query the exact location of your car when it was targetted. Had you entered the 30 mph area, or were you still in the 50 mph zone? The laser equipment has a range of about 1 km so anytime you were in sight you could have been targetted. Confirmation of exact location via the videographic evidence would be required.

The difference on my policy between 3 and 6 points is about £250 per year (for 5 years). So I would agree that £300 is a bargain.

It also could cost sub72 nothing at all - it depends on how much research he does at Pepipoo and how far Cheshire SP are willing to go for their pound of flesh.

Court costs in these cases are entirely reasonable and will be less than you solicitor I suspect.
While going to court costs you a little, view it as a training course in the court system - it's really an extremely cheap way to learn the workings.

In addition there are considerably more people like you than people like them (the age old principle of control and intimidation of the masses by the very few). This is the only situation in which the policy will be grudgingly withdrawn, short of political backbone.

Anyone know the tolerance with regard to distance when entering or exiting speed limit zones.

I mean do you have some allowance to slow when entering a reduced limit area, or by law do you have to be no more than the new limit when you pass the sign. Same with accelerating into a higher limit, can you not do it untill passing the sighn???

Liebchen - If you are driving in any scam prat area - they hit you before you reach the higher sign limit. Is common for Steviebabes to do this to anything that moves. Und standard practice in Brunstormia und LanCASH££££re. Und they may also monitor as you approach the lower limit - based on my useful gadget sounding off alarms of a laser hit yards before passing the lower speed lollipop. But since I have seen him long before he has seen me - as am COAST type driver - und wide awake to scam merchant practices ... Always been legal!

But surely if you win the costs are awarded to you. EG they pay for your time and your solicitor?
