The details, a mate bought a car approx two years ago from a garage all good no problems until yesterday when he was contacted by a finance company saying there is outstanding money on car. He still has the advert which states hpi checked ,the garage has since closed . I am going round to see said mate this evening it would be good if I could tell him where he stands, what do you think?

I would have thought that if your mate still has the advert and a receipt to show he is an innocent purchaser from a dealer he can tell the finance company to take it up with whomever deals with the creditors of the closed down business.

Also two years is taking the piss a bit.

I was in a similar situation many years ago. Took some sorting out, but they found in my favour eventually.

Did he HPI check it himself? Or rely on the dealer/advert?

As above, invite the finance company to go speak to the garage.. Also ask them to consider Equity's Darling.....

This suggests he can politely tell the finance company they can go fish - http://www.lawgistics.co.uk/legal-article-business...

Not necessarily. It may have taken the finance company that long to be certain it has no chance of getting a brass farthing from the erstwhile dealer. So they are now hoping the OP's mate isn't clued up.

Makes no difference, unless the finance company were telephoning from the early nineteen sixties...

The finance company are trying it on. They have no claim on the car and no business mithering you: no matter what HPI's dishonest television adverts suggest, cars with outstanding finance cannot be repossessed.

I would suggest telling them to fk off.

Had very similar thing happen to me. Advert said "immaculate, starts first time, engine perfect". Had a long way to travel so specifically asked on the phone "Is there ANYTHING at all, however small, that isn't perfect?" - "No sir, it's a perfect example, you will definitely buy it if you see it".

Travelled down... 5 attempts of ignition before it started!
"The advert said it starts first time..."
"Yes, it always starts, you have to try 3 or 4 times and after that it starts first time!"

Test drive... turbo clearly not working.
"The advert said the engine is perfect..."
"Yes it has had a replacement engine fitted from a non-turbo model, so the engine is perfect but the turbo doesn't work."
