No sign of a NIP yet
Discussion
Hi all,
No doubt yet another thread on here about worried likelihood outcomes.
Essentially the following:
- 4th Feb, I got pulled over on the M45 by an unmarked BMW for a recorded speed of 90.73, which is written on the green slip that they gave me. I was told I needed to do nothing else and Warwickshire Police would be in contact with me.
- I was a bit of an easy target as there was only myself and this other car. There was also a question about my MOT expiry (ANPR had flagged me as having an expired MOT, which I didn't (It had a new MOT the previous Friday) so it seemed it was just a glitch or slowness in the database being updated. Either way, I showed them the certificate and I was on my way.
- I was heavily delayed by roadworks and therefore stuck my foot down to not be late for an after-hours bit of work for a client. Either way, it's my fault as I should have left earlier.
It's now Feb 29th and I've had nothing through the post! From some general reading - because I was pulled by the fuzz they have already given me "Notice" and therefore a 14 day notice does not apply.
So I guess my question is whether it's normal to be waiting this long for something to happen, and whether I should make contact with someone. I was rather hoping it would be a FPN 3 points / £100 fine affair, but could understand why it would be more.
I'm either:
a) Being forgotten about
b) Not being patient as they are really busy
c) Expecting to go to court
Any advice welcomed, and based on any previous experience.

The NIP would have been read at the time of the stop and may even be on the ticket you were given so the 14 day postal NIP limit doesn't apply. They usually write to you within 3 weeks to offer a course and or ticket. If they are taking it to court they have 6 months to lay papers before the court.
I'd imagine you would be given an FPN + 3 points and it will arrive this week.

I once got pulled for just under 90 in a single carriageway NSL (60) limit. Policeman told me he could not issue a fixed penalty as I was going too fast so wait for the summons. As somebody has already said they have 6 months to issue the summons but in my case nothing happened.
Good luck op but don't rely on them not prosecuting.

Correct that the 14 day notice period does not apply. Chasing them up is not very sensible. Probably too fast for a course. Within the threshold for a fixed penalty. If court proceedings are instituted then they have 6 months to issue a written charge and postal requisition, or if using the "old method" then to lay the information at court. I got pulled in my youth for doing three times the posted limit (empty wide dry road with no joining roads houses etc, but still not clever)
Nice traffic cop called it 70 and gave me a fp and three points,
Veeerry lucky.

3 points for 70 means it must have been a 50/60/70 limit - were you travelling at 150, 180 or 210mph at the time? In which case extremely lucky.I got pulled in my youth for doing three times the posted limit (empty wide dry road with no joining roads houses etc, but still not clever)

I was in two minds about how sensible a chase up was. On the one hand I'd be asking for something that might not happen, and on the other hand I was concerned that the paperwork had never reached my house and I might be ending up in court for not responding to something I never received.Gary C said:

Yep, decent traffic police man was ok, but made me think a lot and slowed me down a great deal. Not big and not clever.
