Friend of mine lost control of her car on a dual carriageway for some reason and rolled it, unfortunately hit a traffic cop who was parked at the side of the road on his motorbike, killing him instantly. She was breathalysed at the scene and found to be well over the limit.

Looks like a lengthy prison sentence over here (Central America). Wondering what it would be in Blighty?

Max 14yrs in prison.
http://www.cps.gov.uk/legal/s_to_u/sentencing_manu...

The exact sentence is going to depend on how drunk and how bad her driving was - have a look down that page for the guidelines.

I think we can guess the reason she lost control.

I had a look for North America, max 20 years for intoxication manslaughter although can be as little as 2 years. I thought it'd be much more in the USA.

I imagine a prison here, despite being no picnic, would be preferable to being incarcerated in Central America somewhere, such as Mexico, el sal or similar

Holy st!

Terrible, terrible thing to happen.

Being well over the limit negates any sorry feelings I have for her. She has killed someone through her own stupidity.

Feel very sad for the policeman's family. Terrible news.

Considering the location...

In truth, it probably depends on how wealthy she and her family are. And how willing they are to pay up in order for her to avoid a jail sentence.

Is that the appropriate offence?

Very true.

But on the flip side there is a possibility that, having killed a cop, she will face extrajudicial reprisals that can be very unpleasant indeed.

More unpleasant than death?

"For some reason" - I think I can guess at the reason.

Over here I would imagine a Death by Dangerous Driving Charge so up to 14 years.

Might include death, apparently.

All in all a tragedy for the cop, his family, the driver, her family.

I don't know. I wasn't there.

But somebody who was is dead. And it's difficult to lose control on a dual carriageway without being at least careless.

Death by Dangerous Driving, presumably? Would they have enough for a manslaughter case do you think?

Either way, given the facts of the case I guess the solicitor would go for an early guilty plea so there would be 1/3 off the sentence - so 9 years and 8 months would be the end result, though an offender only serves half their sentence in most cases, meaning they'd be out on licence after 4 years and ten months.

Being that she is a woman and therefore dealt with more favourably by Uk courts

i would say 2 years and a few on licence in UK.

Central America is probably 10 years minimum, but she might not make it out alive.
