I've had a letter from a debt collector claiming I have a parking ticket at a hospital, I asked my ex and she said yes she got a charge two years ago after borrowing my car but she wrote to them and said she entered the wrong reg at the ticket machine, she heard nothing after this.

I called the debt collector to dispute the charge but they said I can't argue as I have a CCJ over it.

This is all news to me!

I've checked my credit report and the government website and there are no CCJs against my name, so what is the best course of action from here?

Ask them to send you the CCJ or court case number. It's up to them to do the leg work.

Hrm, the question being is did they serve a notice under POFA within the required period?
You should be able to transfer liability by naming your Ex as the Driver. Were you the keeper then?

Yes I was the keeper, Today was the first I'd heard about any of this. The ex gave me a copy of the letter she sent, I'm more concerned about having a CCJ I've never heard of.

They are saying I've been to court it's all done and dusted, judgement has been made so pay up, no right of appeal. It's only £170 but still, I feel I'm being told "yeah all this stuff happened you don't know about, give us £170"

If nothing is showing on your credit file then a CCJ jasn't been awarded against you, as mentioned before ask them for the case details as to me it sounds as if they are bluffing you to pay up to make the apparent CCJ go away.

Well, if they *do* have a ccj (have you moved since the initial letter and now? and have you kept the dvla updated with your address) then you can apply to have the judgement set aside, but it may cost you to do this (although you may ultimately recover this from them).

As someone else has said, get the CCJ details (Case number, court, date) and verify it with the courts. Odds are they may well be bluffing if your address has not changed. If your address has changed, and you have kept the DVLA up to date with your address then you have greater grounds for a set aside as they should have checked with the DVLA again before taking the case to court.

Had similar. Some pie key type turned up on the doorstep and decided to intimidate. Wrong doorstep for him that day.

I feel for the normal decent people in the world that succumb to these leeches.

My address has not changed, I've had no communication until today, the letter my ex sent them clearly says she was driving, how could I have a CCJ if thats the case?

I'll ask them for the details however if I do have a CCJ where do I go from here, I honestly have no knowledge of one and the government website has just charged me £4 to tell me I don't have one.

I'm a little bit annoyed as I was about to get a loan for an extension.

If you are the registered keeper how would they know your wife's name to write to her?

She opened my mail, she responded.

One of the many reasons she's an ex.

Don't panic yet, but remember there are three main credit reporting companies, and they don't always mirror each other (over the years, we knew which ones lenders liked to use, so you could funnel mortgages according to the state of the best report!). According to some of the building societies, Call credit are pretty good at recording most of the credit history of people, and are the report most used by certain ones, so just double check on there. It shouldn't happen, but I have seen occasion where Equifax and Experian record different information, including CCJs, for the same person.

I'm probably wrong...

But if you have a CCJ that you haven't paid or made arrangement to pay over time... doesn't the Court send round the boys in blue?

Is "bluffing" not the same as "Lying" then, given this is a legal matter albeit civil court?

"Just pay it and move on"... Isn't that the standard response becoming of PH these days? Because seemingly the private parking companies are fine, moral, upstanding businesses with no underhand tactics.

If a CCJ has been issued, are you sure it hasn't been issued in your wife's name? These debt monkeys are not exactly tenacious in their fact checking - you may well be the RK, but the CCJ could have been issued to your wife.

Not usually, it's still down to those you owe to try to collect. They can get the high court to attach bailiffs to the job, but not the cops, it's civil

BIB deal with criminal matters. Bailiffs deal with civil matters.

This is about the most accurate advice on this thread. But I will add to register on PePiPoo and post on their "private parking" forum, and do the same on MoneySavingExpert.

Oh, and stop communicating with soddin' debt collectors hehe - talk to the organ grinder not the bleedin' monkey wink .

A CCJ won't be registered against your name until 30 days after the judgment has been passed. This is to allow the debtor to pay the outstanding judgment figure and have no adverse entries on their credit rating.

Once the 30 day period has passed, even if the CCJ is paid in full, it will still show on your credit record as satisfied. This will have more of an impact on your credit rating.

If it is proven that here really is a CCJ in your name, for the sake of £170, I'd pay it ASAP and learn a lesson. Time and money spent attempting to get the judgment may result in a CCJ being placed on your record for 6 years.

Ta wink

Yes, indeed, debt collectors don't care - but they may well have certificates from the court, to which you can complain about their conduct. If they are threatening to collect on a debt that does not yet have a CCJ, and they are saying there is one, then that is a serious offence.

If as you say you have not moved, then either they have a CCJ against your partner, or they are bluffing, or just maybe, you've managed to miss the notification from the courts. The latter would be rare, but does happen, and is grounds to have a CCJ set aside if it has happened.
