It's taken 20 years but they got me... NIP arrived today alleging 64 in 40 (variable) section of m25 (junction 20-19) asking fro driver details. Standard stuff I imagine.

Licence is clean.. what am I looking at, and worth fighting or sucking up? I'd roll with the former but something tells me the 1.5x+ face value of the offence, once taken out of rational context, might be requisite justification for a fairly prosperous fine?

Never even realised the variable speeds were enforced- gotta love a system that permits them to fine you for being a victim of their own failure to adequately maintain the road network huh?

Too fast for a speed awareness course, but just within the limit for a fixed penalty - £100 and 3 points.

Thats what I'm here to find out..

Although I'd take the fixed penalty I guess it's the lesser of the evils, thanks guys

Well a typical post really from someone who is more angry about getting caught than anything else - basically they are angry with themselves.
It's everyone's fault but their own that a fine is on it's way and there "has to be a way to fight it" even though the evidence kind of speaks for itself.

I thought it was well known the variable speed limit on the M25 was enforced.

My own culpabilities neither here nor there, TBF I look at this kind of carry on as being as morally equivalent of the mob's "fire insurance" and I'm chuffed I made it this far; I'll be happy if it takes me another 20 for the next. If it pleases your lofty standards to hear it, I'm sure there were probably glowy lights indicating the required speed (I don't honestly remember the day in question) that I passed and obviously didn't observe.

I'll explain my point even more simply though - the speed restriction was in place due to the "kangaroo-ing car-park" that the western section of the M25 becomes every morning, the kind of semi-permanent traffic jam current policy seems to have taken as an inevitability rather than try to fix.

FYI around the Heathrow stretch it's not, or at least the difference at which they're triggered is a lot higher, hence why I ignored the signs on the southern stretch I got caught on.

The only real "get-out" on NIPs for speeding is "Procedural impropriety", and even that is rare these days. Typically if the NIP is served to the registered keeper any time after 14 days then you can challenge it. I get a lot of drivers contacting me 6-8 weeks after a NIP is issued for a hire vehicle asking for the date of service, and so far all have been within the 14 day period.

Looking at our data, most of the M25 NIPs are issued around Clackett Lane Services, Junction 8-9 Reigate or Epping Road (the tunnel section I think?)- I can't see any issued between J11 and J16 in either direction.

I'm slightly confused.. Are you saying the variable limit signs weren't on? Or they were on but you thought they were advisory/did not apply/were not actively enforced?

This is the bit I am struggling with as well, I am afraid. To be honest, and I expect I have missed the point entirely, it does sound a bit like you are just refusing to acknowledge the authority.

Yes, if they had changed the M25 to an 8 lane super highway in either direction they probably wouldn't be required.

But they haven't. So they are. You're not a victim if you pick and choose what to obey based on what you thought should have been done.

But I'm probably reading it wrong

Your point being...?

I said the variable limit around Heathrow is either not enforced or the trigger point is WAAAAY over the speed being displayed, as I've never been ticketed for exceeding those signs. Hence why I ignored the ones where I DID get caught on a more southerly section. The other posters were suggesting ALL variable limits on the M25 are enforced. I don't believe they are, from personal experience.
