Hi, have just learnt that I am named in my uncles will together with my other uncle. All estate is to be divided equally upon his death etc. But as my other uncle passed 2 months ago does his share become mine or does it go to his wife ? Please let me tell you now, I am NOT a gold digger but would just like to know....................thanks

Assuming you mean - Uncle A left it to you + Uncle B....but B was already dead.

In which case - unless the will said "if B is dead, X gets it" - it will be like he didnt exist (as he doesnt, now)

Typically, if the beneficiary Uncle died first, the other elements of the will still stand. If he died second then he has already inherited, even if he hasn't actually received it, and the proceeds are essentially added to beneficiaries of his will.

Yes, if Uncle B died before Uncle A, you get the lot. If Uncle B died after Uncle A, Uncle B's share of Uncle A's money gets divvied out according to Uncle B's will.

There may be a clause in A's will saying that if B dies within a certain period of A (30 days is fairly typical, AIUI), he's treated as having pre-deceased A for the purposes of the will. Saves having battles over who died first if they both get killed in the same car crash or house fire or whatever.

If there's an Uncle (or Auntie) C, I hope they've not got too many forward plans, given the rate their sibs are kicking buckets.

I'm assuming it's "50% to OP, 50% to Uncle B", rather than "£20k to OP, £20k to Uncle B, rest to dog's home". If it's the latter, then the dog's home may have just got another £20k, not the OP.

Must be a pretty rubbish dog's home with only 1 dog. I'd be leaving mine to the dogs' home.

Can I claim that was deliberate...?

It's a brilliant dog's home for the one dog that lives there if he's getting £20k extra. Bonios all round!

just depends on the will and the wording. Could be 50% to Uncle B or his heirs and successors in title etc in which case 50% will go to his heirs/successors.

Heres hoping you get loads of money! do you know roughly how many million? wink

Morally Uncle B's Wife will get his share.

Morally has nothing to do with it.

It is entirely dependant on what the will states and the order in which the deaths occurred.

Why? Uncle A might have hated Uncle B's wife for all we know. If Uncle B died first, if Uncle A cared for Uncle B's wife, he would have changed his will.

If Uncle B left a will and Uncle A predeceased him it is quite possible that his wife could inherit part or even all of his share.
If Uncle B didn't leave a will the normal intestacy rules apply. Note that the latter in Scotland are not identical to those in E&W.

hi , thanks to all for your replies. I was just told that we were both in the will and with no other info on anything else in the will. Just wondered.

You must know who died first. Was it the Uncle who left you the money, or the Uncle who is in the will with you?

What if both uncles died overnight and with nobody around to confirm time of death?
