Expired MOT With On-Street Parking

Hi all,
Quick question which I sure has been asked before however I didn't have much luck with the search function. If your MOT expires is it legal to keep the car parked on the street as long as it is not being driven?
Having been travelling all over the place recently with work I have realized that my MOT is due this week however I go on holiday at the weekend and want to know if it will be ok to leave it until I get back. Car will be parked on the street and wouldn't be driven until I returned when I would take it straight for the test?

However balance of probabilities suggests nobody is likely to notice, even less so if it's not being driven before it goes for MOT, so depends if you want to chance it? In strict terms to be parked on the road it should have MOT, VED and insurance.

The Gov website implies you only need a valid MOT if the vehicle is being driven.

But the Gov website has been known to contradict legislation before so not 100% sure.

I think that's just crap wording - if you take the 'logical' reverse view and check the section titled 'vehicles that don't need an MOT' it doesn't specifically exempt vehicles parked at the roadside that are otherwise road legal.https://www.gov.uk/getting-an-mot/when-to-get-an-m...

There's been a car parked on the road outside my other half's for close to 2 years now.
It hasn't moved in a year to a year and a half. It's pretty much a home for spiders currently.
It's had no tax, mot or insurance on it since June last year and has been reported by a few people to the council and it's still there. It did once get a warning on it, disappeared for a week then reappeared (all whilst not being road legal) think everyone's given up trying to get it removed now and let the spiders have it.

Similarly, to the likelihood of it being noticed or being pulled later, one of the people that lives in my road is still driving around in his 2010 3 series with an MOT that initially expired in January and when he eventually bothered to get it tested, for some reason, in early May, it failed on a number of serious things including both rear tyres being worn down past the legal limit to the point that the canvas was showing in areas It hasn't moved in a year to a year and a half. He's since fitted 2 budget part worn tyres, but not bothered to fix any of the other issues that the car failed on and hasn't bothered to retest the car either
As a result of the MOT expiry the car isn't taxed either now. Given that the car is driven everyday he's doing well so far with 6 months and counting and not being pulled by Police, etc, so ANPR is clearly working well in this case.grumpyscot said:

Ring DVLA and ask why each of your reports has been ignored - the usual response is that they've been passed to their contractor in the area to deal with. If it's too far from their office, they generally can't be arsed to go take a look as it costs them more in fuel than they get paid for doing it. Bothe the Police and Council have told me not to bother them with triavality they havent the man power or resources. They have placed only the front number plate on the dashboard, so the DVLA when they photograph number plates cant do it as they require it to be placed at a certian place and the angle procludeds not being on the data base, sometimes the honest are punished. So I just took I did the same took the rear number plate off, however it had insurance, I did not drive it, no MOT and I have just left it there for over 10 months now! As long as the govt get the VED they dont care.

We had this situation where I live for almost the same time frame. However the council stickered it to say it was going to be removed as fly tipped waste. Then low and behold they took it. What did amaze me is how quick you can get a locked, seized in brakes, un moved car onto a flatbed. Took around ten seconds. It hasn't moved in a year to a year and a half.
