Who can request a DBS Check?
Discussion
Hi all
I am self employed for my main job, but I do some extra work sometimes for another organisation.
I have been contacted by a third party agency who want to collate all my certificates and this includes a DBS.
I agree with the need to have it done - but I am worried that this third party, who are not my direct employer, will hold all this data.
I checked on the .gov site and it seemed to say that 'only an employer or licensing body' can ask for a check - this third party company is neither of these things (?).
Is this company entitled to ask me for this - I also looked online and you cannot DBS check yourself by the looks of it.
I appreciate any info!

It seems there are agencies who will carry out on-line DBS checks, perhaps this is the only way to get round not being able to apply for a check yourself.

N.B.: I'm not recommending these agencies, merely drawing attention to them.

There needs to be a legitimate need.

Bit of a moot point if the OP is happy with it being done. The law on managing data correctly is tightening up all the time and GDPR will strengthen it further. I think its reasonable that organisations use third parties to perform such specialist tasks and besides they may also involve other bodies like CIFAS or equifax who are more 3rd parties in the process. If you detect any abuse then the hard thing can be working out where the leak came from but the law is on your side, supported by the ICO.
