Hi guys,

I was recently involved in a minor accident and wanted to get peoples thoughts and opinions.

I was driving down a country lane, when I saw a car on the opposite side flashing the main beams at me. Not knowing why he was doing this I backed off and slowed down significantly. Sadly behind this car, obscured from view from the headlights, was a black BMW blocking both lanes.

I slammed on the brakes but couldn’t manage to stop the car before glancing the rear of the BMW. In terms of damage, my car has had one of the spotlights dented and glass smashed as well as the number plate and surround falling off. The BMW has a 3-inch scratch through the paint down to the plastic on the bumper.

The BMW owner was quite young and wanted to settle the incident outside of insurance. In terms of blame, who do you think is predominantly at fault in this situation?

The BMW driver is unaware that I have this video of the incident.

Thanks for your help

I'd say you were 100% to blame.

As others have said, you're to blame there.

Just be a bit mindful why the other person is asking to settle the incident privately (rather than via insurance) - most probably because a non-fault claim will bump up their premium for the next 3 years by several hundred pounds. But they may have other reasons...

Did you get the other person's details? Also, have you checked to see that they're insured via askmid?

Cheers guys, I thought it would be more 50/50 to be honest as he is obstructing the road. How could I have avoided it? Or is it more the case of being unlucky in the circumstances that there was another car making it more difficult to see?

Thanks for the advice, have got all his details and already checked that he is insured.

Be able to stop within the distance you can see to be clear & reasonably expect to remain so.
i.e. Drive within the limits of your vision.

By driving so you can stop inside the distance you can see.

My dad taught me 'never drive faster than you can see'

If visibility is reduced then drive at a reduced speed.

I'm sorry if i sound patronising and we have all been guilty of it but you should always drive with needing to come to a complete halt at a moments notice in mind.

If that was a person crossing you would have had exactly the same notice and you still wouldn't have been able to stop - the consequences would have been drastically worse if that had been the case.

Unfortunately yes its a case of your fault. What on Earth is the idiot doing in the road like that though?

You drove straight into him and are asking who's at fault?

If it goes to insurance I would tell them your vision was impaired by the tt flashing his main beam at you.

It probably won't help, but might make you feel better.

The BMW was moving.

It wasn't parked across the road, per se.

If you stop the clip at the point the oncoming car is just in front of the camera car and look at the position of the BMW's front wheel in relation to the white line in the centre of the road, you can see that it moves further out up until the collision.

Very interesting replies.

So If I fancy making some money, I could park my barely running old banger on a main road just round a sharp bend and wait for a poor sod to run into me, then claim for the damage and whiplash too without any repercussions. Bloody great!

How is this video any different to what those crash for cash scum do?

If you can prove crash for cash then that'd be something different.
A large part of that is that they are in front of you already in plain sight & they change what they are doing abruptly & unexpectedly in order to specifically cause a collision.
It's fairly obvious in a video what they are trying to do & they usually try to mask it by there being two of them in cahoots.
There is nothing in the video to suggest such a thing.

Not particularly helpful of the car coming the other way to blind you whilst the car you hit is manoeuvring.

Wasn't a great idea for the BMW to pull out like that either, it would've been easy for him to see your headlights coming, but unfortunately it is your fault for not being able to stop.

This, which is basic roadcraft.
