Hi,

Just sold an item on eBay. It was listed as "collection only" The buyer agreed to arrange for his courier to collect.

I did say to him in emails and texts, that I wouldn't be responsible if the item was damaged during transit, and that I wouldn't sell it to him if he didn't agree to my terms. He came back saying no problems.

Courier collected the item and it was delivered successfully to him, he even left me a good feedback. Today I get a text saying the item is not working properly and he would like some money back or he would open a case with eBay if I refuse. I explained to him that it's possible the item was damaged during transit, and that I wouldn't be responsible if that was the case.

Just wondered where do I stand if he opens a case with eBay. He did pay using Paypal.

You lose I'm afraid. E-bay will side with the buyer.

Unfortunately just like the law, you cannot make agreements with buyers outside of ebays rules and expect them to follow them or win if they refuse not to.

If he opens an ebay case for an item not as described, you will have to refund him and if you ask for it to be sent back to you then you will by expected by ebay to pay for the return postage not him.

You can say that as it was collection only, it was sold as seen when he came to collect. Now its not your problem if he sent someone else on his behalf to check it out, that was a risk he took.

I know that's not quite eBay's rules, but I hope you follow my logic there.

Yes I do. I even sent him pictures of the item with dates on it. He was happy with the item.

The truth is I don't have the money to refund him if he did win. Can eBay take the money without your consent from either the current account or credit card registered in Payapl

He won't win the dispute if the eBay listing was collection only.
You can just lie and say he collected it and inspected it upon collection.
His good feedback was proof of that.

Perhaps the OP doesn't want to lie.

Surely the reply is to say that the buyer's agent had time & opportunity to inspect it when they collected it (but chose not to) - anything after that is between the buyer and their agent.

Demanding a partial refund is against eBay rules. Report him. If he left positive feedback beforehand, it reinforces your case that he's simply trying it on.

You've been had

Either retaliate dirty as suggested or tell him to return for a full refund
Remember all messages sent within ebay are logged

Out of interest what was the selling price and how much does he want off?

good feedback means nothing, he can still raise issue with paypal/ebay if he paid paypal.

always collection and cash, if they pay paypal refund it.

I don't think partial refunds are against the rules. Demanding them with threats (or negative feedback, for example) might be, but offering to settle with a partial is all part of the fun of the fair.

It may well depend on what the agreement was about the agent coming to collect. I've been to court on this very point -- a collected eBay purchase, collected by a courier on stipulation that they are an agent who can check the item. We won, but doesn't mean that you will as we had a particularly poor claimant.

Paypal can/will take the money off you and ask you to re-imburse the account. If Paypal decide the case (rather than YOU giving the refund) they will also not refund the Ebay fees. So you are left with no sale income, no goods, and paying the selling fees as well! I had it happen to me recently. Ebay said they would refund buyer if I didn't (saying nothing about fees) and within 21 minutes of sending that email (which I hadn't seen - which was probably fortunate!) they had refunded buyer. Why was it fortunate I hadn't seen their email stating they would refund? - well If I had refunded him they would have also done it, and I'd be left with even more loss! This has happened to others apparently. Ebay (or other selling methods) is great until it goes wrong! I've sold hundreds of items over the last few years with no problem (I'm a hoarder!) and this month I've had 2 items "not received", so it makes me wonder maybe temp staff doing deliveries, or (more likely?) peeps short of money at Christmas so grabbing all they can. Next year I'll be sure not to sell near Christmas.

I rarely if ever sell anything on eBay unless it is collection and cash only.

What happens is people click on the buy it now or win the auction, then pay by PayPal. What you then have to do is to cancel the sale and refund the money, then tell them to collect and pay cash, or relist it.

If you let them pay by PP and then collect you can kiss your money goodbye, because you will have no 'proof of delivery' in eBay's terms.
