An AMC will be looking to claim directly from tp so if tp messes about, that will delay the whole process.

I would use your own insurer. If you insist on Merc bodyshop over their approved repairer, you will have to pay the difference, although that can be added to your excess and any other out of pocket expenses you have for your legal cover to claim back off the tp.

You will have to disclose the claim either way, and until such time as the tp has paid out you and reimbursed your insurer, your ncb will be affected at next renewal. Although you will get a refund when it's settled and your bonus is reinstated.

AMC's are a waste of time.

My first no fault claim was a 3 car smash with me in the middle so I went through an AMC, it took them a month to write my car off whilst I had a courtesy car. Constantly chasing them it wasn't worth the hassle.

Few months ago my wifes car was hit when parked (by a bus) only a tiny scrape but a scrape none the less that the driver tried to drive away from. I informed my insurance but gave the bus company the chance to make things right, we had a hire car for a week and they painted the car (to a half decent standard) it was more hassle getting them to pick the hire car up!

My advice is always go through the TP insurance if they are willing, if not use your own.

These things grind on for ages - wife was driving our (then) brand new A4 Avant and was hit on a roundabout - it's 3 lanes entering, but on the roundabout itself more like two - car going straight over wandered out to the left and hit my missus, who was turning left.

Other driver admitted fault at scene. That was July.

Fast forward to two days ago and FINALLY the other side have replied to my insurer's solicitors and we're now going to court as the other driver has now decided my wife was at fault having 'veered' out of her lane. Clearly not the case as the wife was turning left, not right, but there we go.

Thank you for the replies,

So to clarify the only difference in me going via my insurance is I will have to pay the excesss and hope my insurance company successfully claim against the third party?

That is exactly what I sense is happening with my claim at present. At the scene admitted liability and wanted to settle cash.
The AMC has contacted the phone number I was given at the scene and it turns out that the number is incorrect - even though the person rang my number at the scene?

What do you recommend I do? just frustrating I'm at no fault yet the TP has hit me and claims no damage!
Anybody in the right mind would see my evidence and statement and be able to see everything clearly.

I would go thru my own insurance, let them use their own approved bodyshop, and let them have the hassle of claiming off the tp. Especially as you have ULR cover (uninsured loss recovery) so they will be fighting to get your excess back (yes, you're correct, you'll have to pay that initially). It'll almost certainly be settled in your favour eventually, given what you've told us so far.

I was in this situation about a year ago. Deliberately rammed by a transit driver. I went directly to the transit drivers insurance co., told them that I would sue directly. They faffed for a long time whilst their driver failed to respond to them. They folded after a month and with the threat of involving an AMC.

I had this many moons ago. Entered and exited a roundabout from the inside lane of a two lane dual carriageway, throbber in the van who entered the roundabout in the outside lane tried to exit in the same lane as me. Took out the rear passenger door, rear wing and damaged the rear wheel with his offside front wheel, the only additional damage to his van was some scraped wheel nuts. We both stopped, he took an accident form of the well thumbed pad that he had handy and away we went.

Several months later I get informed that said throbber is trying to claim for the whole new side of his van and that it was all my fault. Eventually, the insurers decided in my favour, but it took nearly a year. Unfortunately, this was before cameras in phones and well before the dash cam days.

I have a dashcam in the car now that is only for use if I have yet another idiot who can't drive and tries to put the blame on me.

Would it be worthwhile to get it checked over by the insurers approved repairer, they will give the insurer a quote for the repairs. Ask for a cash settlement and then use a Mercedes approved repair to carry out the repair?

or potentially depending on the wording of your policy...

Appreciate he replies everybody. Wish I had asked for some advice earlier.
Looks like the only benefit of the AMC is to get a flash courtesy car?
Rightly as some of you have said above whether I go via own insurance or AMC I do need to declare the incident upon renewal as it is on the register now I'm told by my insurance company.

I will proceed with my insurance enough company - pay the excess and claim that back smile that is after all why we pay a premium in the first place!

Thank you again - if I have missed anything above please let me know.

Have a great weekend!

They will ask:
"Have you been involved in an accident or incident in the last x years?"

Not "have you made a claim?" or "were you at fault?"

So yes you have to declare, regardless of whether you claim off your insurer or the third party and regardless of fault.
I don't like it either.

Have you had a courtesy car off the AMC? I doubt you have as your car sounds drivable and hasn't gone in for repair yet. But if you have, then the agreement probably means you have to stick with the AMC until the bitter end.

No nothing at all from the AMC apart from no real progress!

Check this with your insurers, not all insurers insist you pay the difference. If it was my car, it would only be going to Merc.
