Court date carried on...
Discussion
Hi all,
I have a court date next month, and evidence was due friday however third party hadn't submitted it by the due date which SHOULD be good for us regardless as they have our evidence, however we don't have theirs. So my solicitor contacted theirs today and they basically said they've had no signed documents from third party/defendant for a while as he's left the haulage company he worked for and they've not had contact with him for a while.
They've given them 2 weeks before my court date to sign the papers, or they'll have to settle. But third parties insurance is trying to push for them to settle as they're worried he won't turn up to court.
So based on that - if he doesn't turn up, will that put me in a much better position? And if no response from him, I don't go to court because he can't sign and will I automatically get 100% settlement?
