Posted up in the biker banter pages but need some help with the legal side of this as I'm yet to hear from the PC that said he's call me and only have a day left.

I was pulled over when leaving work yesterday afternoon and given a rectification notice for my bike (noise), fair there is a hole in the downpipes, picked up on the MOT in November, I was planning to sort it over the summer after a big exam anyway. I have 2 weeks to sort the issue, have the slip stamped and send it back.

Now fixing the bike in the alotted time is an issue, looking at the pipe I am going to try and bodge it back together later but I don't know whether some aluminium sheet and chemical metal will be sufficient given the hole(s):

I am happy to order the part, however I am out of the country from Friday (6am) for over 2 weeks and am working a full 13 hour day tomorrow. Even if I order a new manifold section it'll take a good week to arrive, before I deal with my mechanic's 4 week waiting list for work and then work out how to get it signed off by a testing station on a weekend.

Can these time periods be extended at all?

I have the day after I return off work to deal with jet lag in which I can run it to the garage to have the parts which should arrive whilst away fitted, would this suffice?

Alternatively is there a means of declaring the vehicle as off the road as of tomorrow evening to basically say "you've said its faulty, it's no longer on the road"?

I'm guessing you were issued a VDRS? (Vehicle defect rectification scheme)

This means no action will be taken UNLESS you get the form signed and stamped by an official MOT testing station to confirm the work has been done within 14 days. If not done in this time frame you can be prosecuted for the offence. Which would've been committed on the date you were stopped and issued to form.

Just send an email to the officer involved I'm sure it won't be a problem. It would be down to the officer to initiate any further action rather than an automatic process if it's anything like we do.

Indeed it was that and was done under the scheme, the guy said he'd call today but have had nothing as of yet.

How would I get a contact e-mail for him?

Call 101 and ask for it. You should have the officers number of the slip.

Thanks, tried and was told they could not give out an email address and as I don't have his name (just a PC number) I couldn't be put through on the phone.

One thing I don't get is how this was fine to just be an advisory on the MOT but is now illegal, its not exactly something you can be reasonably expected to check, I know it's a little loud but it always has been, with no difference now vs. a week after the MOT when I collected it.

Thats rubbish about the email address - its a company email address not a personal one and theyre more than allowed to give it out. They should have sent the officer an email on your behalf for him to contact you when next on duty - just laziness on the call handlers part. The OP rang for help and advice and left empty handed

Just in from an hour and a half trying to bandage it, unfortunately it just didn't work, at all.

On a closer look there are about 5 other (smaller) holes and the big ones were so wide they just blew through it when turning it on to heat up and set.

Have just ordered new pipes and have spoken to my garage to get it booked in, hopefully that'll suffice.

Reckon if I SORN it and fix on my return it'll be ok?

As mentioned, if you fail to get it rectified within the allocated time then you will be fined regardless if it's SORN or not.

Yeah that was the intention, I explained everything at the roadside and hence him saying that he'd call me today but it never happened.

He did say that 3 weeks would likely be ok though as "the ticketing team would take that long to look at it"

I struggle to see how I can fix it in time given I'm out of the country and the parts take 10 days to arrive, it'd be even worse If I wanted genuine parts as according to Honda as the manifold is on backorder till June

The MOT was 5 months ago, the obvious noise over time you probably didnt notice but it was obviously loud enough to warrent interest from the five-o. If your mechanic is busy take it elsewhere, order the part to the garage and leave the bike there while you're away.

What happens if you SORN it, then an MOT is not needed

That's my thinking...

The garage has a 2 week lead time acind only a small workshop, they can't store it there. Downpipes ordered and are due in a week's time.

SORNing will not make the slightest difference to any of this, the VDRS is either complied with or not, scrapping the vehicle is the only defence.

I would suspect the officer will need to initiate the case against you, if you keep him/her informed and get the form back as fast as humanly possible there will be no issue. I'd avoid giving too many details of holidays/personal commitments as to any delay, Police never like feeling like they're bottom of the list, part on backorder and the date you've ordered it will be enough.

Try again via 101 tomorrow - if no joy with the call handler ask to speak with the control room Sgt and explain why you need to get a message to the officer.
