DVLA A Bit Confused
Discussion
Right got back from holiday today and opened my mail, one letter was from the DVLA regarding an unlicensed vehicle.
I have a minor panic, has my bank account been scammed and emptied, or has a DD been cancelled, check bank account on phone all is fine, DD's for both cars have been taken out within the last month or so. I then read the letter properly, its relating to a car I owned ages ago and was written off in an accident in 2011. I SORNED the car the day after the accident as the tax was running out and it was clearly going to be parked up for a bit whilst the insurers figured stuff out.
This is the 1st time the DVLA have got in contact with me over it, its weird I binned all the stuff relating to the write off of that car in Jan this year as i could not see why I would need it anymore.
On the letter they have asked me when i sold the car... it was sometime in may or June 2011 not sure when exactly.
Now I am a bit confused, do i fill out the little form and send it back with a made up date in? If i do this are they going to come after me for back tax or some other daftness?
I am 99.9% sure I got confirmation from the DVLA that the keeper had changed a few weeks after the car was written off, I am not sure of this as obvious when stuff like that happens there is lots of bits of paper relating to the write off, oh and it was 6 years ago.
Really confused why they would have left it 6 years to chase up SORN?

I would suggest that the vehicle was never changed from your name and someone has recently applied for VED, I had a similar problem. On the 26th November 2009 I was involved in an accident which resulted in my Freelander being written off, as the tax was due to expire on the 30th and I doubted the insurance would have done their inspection by then I took the advice of the local vehicle licensing office and sorned the vehicle. After the insurance inspection and subsequent total loss I retained the salvage and the vehicle lay in my worshop whilst I sporadically carried out repairs, Come the end of November 2010 I wondered wheteher I should resorn the vehicle but on loking up the DVLA website it stated that they didnt send sorn reminders for insurance written off vehicles so I didnt bother. At the end of February 2011 I had finally finished the repairs and had the car MOTd and VIC checked before applying for the road tax, 3 weeks later I recieved a forty pound fine for having a vehicle unsorned or taxed for 3 months and they wouldnt back down.
If the vehicle was written off it would then belong to the insurer and the V5C should have been surrendered to them. Assuming he can remember which one it was (and that he didn't buy it back as salvage like the previous poster), I would suggest that the OP tries that route to establish the date.

Oddly enough I have been insured by the same company for ages, and am still with them now! I now have a date, but am a bit concerned why the DVLA are chasing it 5 years after the vehicle was sold. So I assume I will get a fine even though I am 100% sure they have been notified.

Assume the worst when dealing with the DVLA, keep records of everything. Not to be confused with the DVSA
To be honest I had all the stuff relating to the car in a file at home, I discovered it when i was looking for something to do with my tax return this year and thought why am I keeping this for and binned it all! nikaiyo2 said:

So just give them date. If they do pursue it further tell them (nicely of course) to stick it where the sun doesn't shine!
If they still continue to give you grief, get your MP onside. Waiting 5 years to slap you with a penalty is totally unreasonable.
