OK someone who shall not be named...... clocked doing 62 in Av 50 on the M1 South Yorks. Jct 35 and 35 on May 9th

No reason other than being careless and missing the first camera I think. Zero points on licence but did have to go to speed school 18 months ago, That was the first "catch" after 25 years of driving.

Now in some cases I read its a Band A offence (where its something like 57 -65 MPH) and thus 50% of weekly income and other suggest it can be dealt with using a Fixed Penalty Notice and £100. THe difference between getting done on a band A and an FPN would be something in the region of £700...... so if Band A is now the minimum where does a FPN work these days.

No idea what to expect here, anyone been done under the new rules....................I will pass all thoughts on to the villain of course !

Sensible thoughts and experience welcome. Feel free to slaughter someone of course for such a law breaking act at 1pm on a quiet motorway !

Ignore what you've read online or in a tabloid newspaper.

62/50 is a speed awareness course. Otherwise, a fixed penalty. £100 and 3 points.

Out of interest when would a Band A be applied then??? Otherwise anything in BAND A would be a FPN?

Band A will always be applied - £100 is now the minimum fine, but the starting point for Band A is 50% of your weekly income.

The police can issue a £100 FPN and 3 points but that is solely at their discretion. It's only if you go to court the new banding will come into play.

Case dealt with out of court = fixed penalty.

Case deal with in court = fine.

Edited, but still wrong.

ETA: don't believe everything you read online. Even if it's on a .gov website.

You can see why its getting confusing, I think there is much hype. I think the court non court issue makes sense,

Would it be right to assume that someone in the Band A speeding bracket would only go to court if they ignored the notice or indeed was a persistent offender?

A first timer in band A admitting is not really going to court is it and thus is a FPN

Well why don't you correct the mistakes then?

"The minimum penalty for speeding is a £100 fine and 3 penalty points added to your licence." Source: https://www.gov.uk/speeding-penalties

This is first class muppetry from our civil service. There is no minimum £100 fine. That's an entirely made up fact. Probably confusion with a £100 fixed penalty.

Example 1. Offender with no income appears in court. The court deems £120 p.w. as relevant weekly income and applies a Band A fine. £60 fine imposed.

Example 2. Offender with two speeding offences appears in court. Fine of £120 for the first offence. No separate penalty for the second offence.

A couple of real world examples of offenders fined less than a civil servant thinks is possible:

http://www.derbytelegraph.co.uk/slow-down-who-s-be...

There is no minimum £100 fine for speeding. Never has been. Nothing has changed.

Probably because it would be a full time job and I have other things to do. Speaking of which...

So in my mind from what has been said - its going to be £100 Fixed Pen and 3 points if I fess up and dont go to court. If I go to court for whatever reason the fine is based on speeding Band and a %age of my income

I assume its safe to say that if dealt with outside the court then they would not know my income, unless there was some information sharing that I would not be happy with

This really isn't difficult. You'll get an FPN i.e. 3 points and a £100 fine, you can't get an SAC as you had one less than three years ago. The whole means tested aspect is completely irrelevant unless you want to go to court to plead your innocence and then get found guilty.

Not a small price to pay if you try to defend yourself in court then, i.e. roll over for £100. Don't role over and still get fined - huge fine.

If you think you've got a defence then you should go to court. Going with a duff defence, failing and being found guilty deserves a harsher punishment than accepting your guilt early on.

Erm, there is no average speed cameras there. Only the new hadecs 3. I take it a 50mph limit was showing on the gantries.

I think you might be correct I checked the docket and it was for exceeding variable speed limit of 50mph between 35 and 35A so assume a HADEC. Annoyingly it was 1.15pm and the motorway was almost empty, very light traffic.

Yes, doesn't surprise me, this is the first ticket I've heard of there, travel it every day and never seen them flash.

He'll know better than to unnecessarily increase pollution there in the future.
Or make too much noise.
Or whatever else it is the lying bds are using to justify the ludicrous limit.
