Who 2 claim off - pothole damges wheel, Stanwell
Discussion
Simon,
I'm going through pretty much the same thing at the moment. Streaky has posted a link to one of my posts above.
Firstly, did you get photos of the pothole in question? If not then I suggest you get back there and take some ASAP before they fill it in and deny it was ever there.
Secondly, was the hole just a hole in the road or following roadworks as per mine?
I believe that if its just poor maintenance then its the councils responsibility to carry out the repairs. If however, it was following contractor works as mine was, then you may find its the responsibility of them (such as Anglian Water in my case) under the roads and streetworks act. Hopefully someone with a legal backgound will be along in a minute to clarify this.
As has already been said, ensure ALL correspondance is written and sent recorded and that you NEVER send off original invoices etc. Keep copies of all letters you send and be prepared for a fight.
Good luck anyway.
One other point, if you hit hard enough to buckle the wheel get the tyre and the tracking checked and claim for this as well!

Thanks for that - it's an Elise so I am claiming for a full geo setup as well.
The problem is - while only one alloy was buckled, it is not now possible to buy it anymore as lotus have discontinued it, should I claim for a full set of alloys or just 25%?
Good advice all round - many thanks.
Simon.
