OK my day is getting worse, my partner now informs me he is being done for "Car Tax Fruad" - Needs to go to court - I know he says he is not guilty - But as we have a family I am worried about implications - does anyone have any information about fines or advice. Cheers all - worried mum

I'd suggest a visit to the CAB would be a very good (& free) move.

Is it just not paying car tax on time? if so thats fairly trivial (normally)

hiya, yep I have suggested he go to CAB, unfortunately its not just paying car tax on time - its car tar fraud (using someone elses car tax as own). cant type that in again as makes me angry. thanks for your suggesting cptsideways.

Guess that what you mention is fraudulent use of an Excise Licence (S44 Vehicles Excise and Registration Act 1994). Maximun punishment is a 5000 note fine (summary) or 2 years imp or fine or both (Crown Court).

This is in addition a charge of using without an Excise Licence.

The fraudulent use offence generally is associated with a charge of theft of a Licence or handling or if lent by someone else they too are charged with fraudulently lending a Licence.

Fairly heavy stuff I am afraid.

Talk to the CAB and try to get some advice prior to the court case, I'm not sure what the deal is with legal aid for this type of offence but they will be able to tell you.

If the hearing is very soon, talk to the court and check that there will be a duty solitor there at the time, get there early and talk to the duty solicitor, be honest and upfront with them and give them as much information in an understandable way. If there are any mitigating factors, taking the car for an MOT etc. etc. then tell them.

If he is telling you he isn't guilty why does he think that?

There is no point him continuing to claim that he isn't guity if he was knowingly driving round with someone else's tax disc in his car. It's not my field of law but I would imagine he's better to put his hands up, admit he's been a prat and get the duty solicitor to put forward mitigating factors about why he should only be fined a small amount and not face a prison sentence (can't see that they are likely to bang him up unless he's got a serious history of this kind of thing?) etc. etc.

Thanks Dwight and piglet for your help. Yep he is a complete twit, dont know what to do about him. I have showed him your replies and hopefully he will now take it seriously enough to get a solicitor. Great forum everyone very helpfull, J
