I went passed a camera van yesterday going about 78 on a 70. I've already got 3 points and yesterday was also 2 years to the day that I passed my test. Does anyone know if I will have my license revoked or have I just passed the cut off point. I did my test early in the morning so it's actually 2 years and 6 or 7 hours if I need to contest it. Fm

FIRST- BE VERY, VERY CAREFUL OF WHAT YOU DAY ON ERE- Pitmansboots ( or whatever he calls himself these days is looking to make a fast buck on whatever you give away).
Then head over to PEPPIPO, remembering that on open forum, there might be a Pitmansboots OR HIS ALTER EGO seeking to suck up information.

Was it 78 on your Speedo or sat nav? Depends what the threshold is in your part of the country whether you'll be done or not. No expert but if they don't contact you within 28 days then you can wave goodbye to it. I think that's right. Other than that I think you'll be screwed as its the day that's on the DVLA system not the time etc.

They need to send the Notice of Intended Prosecution within 14 days of the incident.

Even if you did get caught they might give you speed awareness course if you haven't had one before.

How do you know so precisely what speed you were doing? If it was a speedometer indicated 78 and you braked when you saw the van, then you would barely have been exceeding 70 in most cars. Just wait and hope. If you do receive a penalty notice, then start worrying about it. There's nothing you can do for now.

Try a 'Search' for NIP on here. Comes up very very regularly.

As you weren't stopped at the time an NIP must be served on the registered keeper (as shown on DVLA) within 14 days. This will be through the post.
If you aren't the registered keeper providing it arrives at the RK's address within the time then service will still be good.

I'd suggest you read this:
Gidden v Chief Constable of Humberside: DC (Lord Justice Elias, Mr Justice Openshaw): 29 October 2009
https://www.lawgazette.co.uk/law/criminal-procedur...

In that case the NIP was sent by 1st class post but due to a postal strike was delivered after the 14 day period. Delivery date witnessed by the postman that delivered it.
