Are these things actually enforceable?

Been snapped parking in and empty industrial units' parking space as all the spaces at the gym (unit opposite) were full. And no you cant really park anywhere nearby and walk in as it on the very edge of Leeds centre so tightly controlled.

Been parking there when needed for 2 years and never a problem. Money grubbing bds....hate them.

You should probably head over to the Pepipoo or MoneySavingExpert forums. You'll get some good advice there.

You should probably also remover the reference data and vehicle reg from the image. The parking companies are known to browse the various forums to check up on their victims biggrin

PCS do not rely on POFA 2012 for keeper liability - I won't go into all of the technicalities right now, but they are easy enough to defeat at POPLA if it even gets that far.

I'd reply back with a simple;

" I can confirm that I am the registered keeper of the vehicle, however I understand that you are not reliant on POFA 2012 to hold me liable. Please cancel the ticket or provide a POPLA authorisation code by return. "

There are many examples of POPLA appeals on Pepipoo and MSE, but always mention inadequate signage, proof of landowner authority, and proof of POFA compliance. I'd guesstimate that 95 out of 100 tickets can be overturned on one or more of these three points.

Give them a cheque for minus £10,000... hehe
You never know, they're probably the sort of pond life to cash it!

^^This^^

PCS is a merely a debt collector: it is a trading style of Debt Recovery Plus Ltd. If PoFA 2012 is not being used* by the actual creditor they are going to struggle.

 * Only the driver can be pursued in this scenario. Unless the RK tells them neither PCS nor the PPC can know who the driver is.

Interesting stuff. Turns out there's a few of us at the gym been landed with the same letter. It turns out however the adjacent units have an agreement to let gym members use their spaces outside of normal office hours

I've been advised to bring the letter in to the gym and they'll sort it.

Wouldn't it be more fun to leave it a few months or so? This way said company can waste more of their time and money chasing you for something they can't collect?

I own industrial units on an estate that also has a gym as a neighbour, despite every attempt to stop gym attendees parking in other spaces cars are liberally abandoned all the time. You could try joining a gym that has adequate parking.
This company have been asked to do a job, that job is to stop you abusing someone else.

Nobody was abused you Muppet. I was in an unused space in an empty units car park outside office hours.

Member of the BPA according to that piece of toilet paper. So defeat them at POPLA. Look up MSE parking fine forums on Google. Advice there is sound and it really isn't as complicated as it seems. I defeated 20 tickets from ukcpm back when they were BPA. Steve is right but just follow process and hit this piece of st out the ball court.

Who me ?

As is he of 1000 usernames on here. Last known Nom de guerre was PITMANSBOOTS, but, he's got lots more. Personally I know him/call him as Capt Pugwash, of HMS Submarine Expectorate.

It doesn't matter what time of day or night, it is someone's property and you have no right to be there without their permission.

And it's someone who obviously doesn't what to give you permission.

You are trespassing.

That agreement has likely been rescinded, if it ever really existed.

Best guess is that all the problems are occurring 'during' normal office hours and you are now a victim of someone else's laziness.
Its those 'other Gym customers ' you should be angry with, not the adjacent business owner, for whom things have obviously gotten so bad that they had had to engage a parking company.

By all means complain about it, but direct it at the right people.

You are trespassing.
Ironically, in the vast majority of tickets I deal with, the parking company doesn't have a valid contract with the landowner, only the tenant or management company. I've lost count of the number of POPLA appeals I've won on this basis.

So technically it is the parking company who are trespassing by carrying out their business on somebody elses' land.without their express permission.
